Another thing to consider re: the RHCP deal: they have a new album out this year. It's pure speculation but it's not much of a leap at all to suggest that they were promised a tie-in similar to what Soundgarden got. Releasing the album as a pack-in with the RHCP game would have been a pretty sure bet. If that was the case (again, speculation) that plan would be shot and I'm sure the RHCP camp is probably aware that their release method for hundreds of thousands of copies of their album is now done.
If this were some 3-song DLC pack that was now canceled I could see it being little more than a drop on their radar but if the Guitar Hero game was a big part of their plans for the new album I think they'd be able to raise a pretty big stink if Activision tried sitting on the rights.
Full disclosure: I want Dani California and Give it Away back and I want more RHCP for Rock Band. But I still think it's a reasonable possibility that the situation a bit more complicated than "Activision has the exclusive rights and RHCP can't get them back regardless of the situation".

Regarding Guitar Hero and the Future of Rock Band
We were sad to hear yesterday that Activision was discontinuing development on Guitar Hero. Our thoughts are with those who are losing their jobs, and we wish them the best of luck.
The discontinuation of Guitar Hero is discouraging news for fans of the band game genre. As retail sales of Guitar Hero and Rock Band titles have slowed with time, we’ve been focused on building a robust digital platform for music gaming and have recently crested 2,500 songs available for play within Rock Band 3.
Harmonix and Rock Band continue to push beyond simple performance simulation to pioneer new approaches to music gaming. Rock Band 3 saw the introduction of our innovative new Pro Mode, in which aspiring musicians of all ages can develop actual musical skills through gameplay on guitar, bass, keyboards, and drums. We’re looking forward to the imminent release of the Fender Squier Stratocaster Guitar Controller, a fully functional guitar which doubles as a Rock Band Pro controller (launching March 1st). We are also relaunching the Rock Band Network, a way for bands of all shapes and sizes to get their music into Rock Band. RBN just passed the 1000-songs mark, and its relaunch will now support keyboards, pro drums and vocal harmonies. The music genre is one that calls for constant reinvention, and Harmonix is continuing to welcome and embrace that call.
In short, the beat of Rock Band marches on. We’re continuing to invest in the franchise and the brand that we have built, and will do our best to serve all loyal band game fans. For rhythm gamers out there who haven’t yet given Rock Band a chance, Rock Band 3 software is compatible with a wide range of instruments, including most Guitar Hero controllers. Looking to the future, for fans that want to switch, we’d happily welcome you over into the world of Rock Band.

Bad Religion has thirty years of recordings...I don't get the fascination with 21st Century Digital Boy and Sorrow...two of their worst songs (for my money, at least), yet both of 'em have popped up on Guitar Hero and Rock Band.

Though I don't think those are two of their worst songs. Two of their worst singles, sure, but BR has written much worse songs.Keeping my fingers crossed for that Brand New song to make its way into Rock Band though.

It's just really easy for me to skip past something like "I Love My Computer". The weaker songs that were released as singles are a little tougher to avoid out there in the wild.

I doubt the sales numbers were really that great, but yeah TRU was selling any guitar bundle for $15 + tax on $80. A good number of people got the full band bundle for that price as well through in store pickups of online orders. I got a guitar bundle on Friday and the store I went to had at least 3 copies left, so I don't know how many people took advantage of the sale.

I just recently picked up GH Warriors of Rock and Band Hero the complete band set. I would like to point out that my drum pedals wiring covering peeled off the wire just moments after taking it out of the box. It literally crumbled into sticky little pieces of rubber. Has anyone else had this happen?
