Well to claim a breach of contract, you must be aware of the existence of a contract. You don't necessarily have to know what's in it and could be (and likely is) completely wrong.

If you were disgusted by the inclusion of a playable Kurt Cobain in Guitar Hero 5, you weren't the only one: Cobain's widow, Courtney Love, has gone on record (well, on Twitter, anyway, in what looks a lot like Courtney Love's real Twitter account) to register her disapproval, saying, "For the record this Guitar Hero (expletive) is breach of contract on a Bullys part and there will be a proper addressing of this and retraction." Love plans to "sue the (expletive) out of Activision," speaking for herself, Cobain's estate, and "the various LLCs Cobain Enterprises."

This is even more confusing cause in the Joystiq story it sounds like she was never even planning on allowing his likeness to be used in the game as she was just dragging it out. Bitch is crazy.

Who cares if Kurt Cobain was used as an avatar in the game? If it hurts anyone's feelings then too bad. It's not like they have him doing anything else in the game than just playing (singing) music even if it does seem weird. They're not portraying him as a rapist or anything like that. I wouldn't be upset if they used Geddy Lee t sing Brass In My Pocket or 3 Times A Lady.

So is Demon(s) a required play through or is it just sort of there as an optional like most hardcore songs in the series?
As much as I love Darkest Hour, I'm still disappointed by them choosing this of all their songs. Not that it matters, I usually have to skip the songs to spare the drum sets.

I have a feeling the Cobain thing is just a misunderstanding between the two parties about what they were agreeing on...Love probably thought Kurt's avatar/likeness would only be used for the Nirvana tracks, and Activision probably thought they could do whatever they pleased once the contract was signed and use him like any other in-game character....
Who wants to bet they'll probably just release a patch for the game that makes Kurt only onscreen for Nirvana songs? Seems like the easiest settlement to me....

To be fair, I'm not sure exactly who TXB got in touch with at Activision. One would presume that whoever it was knew not to speak on matters they know nothing about, though.

For all four of us here who care....Smash Hits importing is now available for PS3 in GH5....
Looks like the servers are getting hammered right now for it though, as my download is taking a really long time (and this is for less songs than the World Tour import was, so it has to be a smaller file).....luckily for me my rental copy code worked fine, so I'll take the extra tracks for only the $1.99 cost!

I decided to pass on GH5 during this Best Buy sale. I think I like the mix of songs on Smash Hits better, and they left too many good songs off of the import list into 5 that I think I'll hold off for SM to reach $20 and pick that up and play from the disc.

I like some Nirvana songs but c'mon, the guy was no musical genius. Who cares if he's unlockable or not? I dunno, maybe instead of making unlockable characters and such, they could spend more time making a better game, or use the money that it probably cost them to use Cobain's likeness to get a couple more decent songs for the game?? I quit playing the game because I can't handle the shit songs anymore. I had two more venues to open when I checked the setlist online and there isn't anything worth a shit in the last two to make me sit through any more of these crap songs. Thank God I only spent $3.50 to rent this game and not $60 to buy it.

Not arguing his or anyone's talent. It's just about integrity and respect to both the living and the dead. I have no problem with having these likenesses in the games, I (personally) feel it should be restricted to a realistic setting. Especially if that person is no longer here to speak for his/herself.
But, you're right, it doesn't affect me either. You put that video up there up against the Rooftop Concert in TB:RB and you can really see what respect brings to the table.
