Part of what was kinda sneaky about this Kickstarter was that it used the names of the designers, who weren't part of the company, pretty prominently in the Kickstarter, and didn't really speak much about who was actually producing the game.
I think your sentence is worded incorrectly. They promised to put out a product with the money, but they never claimed they had.
One thing that makes the prospect of refunds more likely is that in the link superdeluxe posted, one of the designers (who again weren't part of the company, they had just licensed their game to the company) said that he and his co-designer hired a lawyer to compel the company to issue refunds. Which means that if the company doesn't follow through, the designers may sue on behalf of the backers.

yeah, that was written incorrectly. i blame my phone. my point is they claimed they were going to put out a game with the money and that's not happen, obviously.

As soon as we learned the true state of affairs, we engaged a lawyer to compel The Forking Path to come forward to the backers and to honor its pledge to issue refunds.

As a project creator here I owe, per my contractual obligations with Kickstarter's ToS, the listed rewards or a full refund, nothing more or less...
I've publicly promised to repay EVERY backer because that is my obligation per the Kickstarter Terms of Service. I am contractually bound to do that much and I absolutely intend to. If I were to immediately pay back as many of you as I could right this moment a sizeable percentage would go unrefunded which would only cause more problems. If I'm dragged into court then everything will vanish into legal fees and I'll never be able to refund anyone else. If a little more patience is dredged up from the depths and I'm given time to work and refill the coffers I can eventually, with some hard work and dedication, refund everyone.

The Kickstarter for this game was canceled a couple days ago. They've decided to run a campaign outside of Kickstarter with different development goals, some of which should be much easier to attain.

Man, if they hit a stretch goal of a PS4 port, I'm totally in. That sounds cool, though I'm not a huge Mega Man fan. I did love, love, love Okami though.

I love Mega Man so this game is a no-brainer, but I can't justify spending $20 today for a game that might come out in 20 months. It's just shy of the original $900k now, so there's no reason for me to jump on at this point.
