I think your sentence is worded incorrectly. They promised to put out a product with the money, but they never claimed they had.

One thing that makes the prospect of refunds more likely is that in the link superdeluxe posted, one of the designers (who again weren't part of the company, they had just licensed their game to the company) said that he and his co-designer hired a lawyer to compel the company to issue refunds. Which means that if the company doesn't follow through, the designers may sue on behalf of the backers.

yeah, that was written incorrectly. i blame my phone. my point is they claimed they were going to put out a game with the money and that's not happen, obviously.

I think the designers hired the lawyer to compel him to inform to backers (and presumably protect the interests of the designers by getting the rights back), not to issue refunds. The money's gone. It appears he used it to quit his job move to Portland.

As a project creator here I owe, per my contractual obligations with Kickstarter's ToS, the listed rewards or a full refund, nothing more or less...

I've publicly promised to repay EVERY backer because that is my obligation per the Kickstarter Terms of Service. I am contractually bound to do that much and I absolutely intend to. If I were to immediately pay back as many of you as I could right this moment a sizeable percentage would go unrefunded which would only cause more problems. If I'm dragged into court then everything will vanish into legal fees and I'll never be able to refund anyone else. If a little more patience is dredged up from the depths and I'm given time to work and refill the coffers I can eventually, with some hard work and dedication, refund everyone.

To be clear, he's not blaming the backers for the project failing. He did blame the backers for bringing in the press, which he claims is slowing down, and ultimately jeopardizing, his refunds:

Cyptzotic has stepped in to publish the game, and will be giving the game to all Kickstarter backers:

Note that they're just giving the game, not any of the other Kickstarter rewards (t-shirt, etc.).

Nothing much happening on Kickstarter right now. A few projects of note:


Monochroma (ends 8/24/13)
A cinematic puzzle platformer about being a kid and caring for a little brother in a chilling 1950s dystopia.

A new studio album from the award-winning world touring video game concert event

StarCraft Universe (ends 9/13/13)
A free to play science fiction Multi-Player Online RPG played through Battle.net on StarCraft II. (No StarCraft purchase required)

StarCraft Universe looks interesting, as it's basically a SC2 mod, but since it works with SC2: Starter Edition, you don't have to pay for the full SC2 to play it. Also, the game's going to be released for free, so the rewards are limited to in-game rewards, soundtrack, and a few other things that are not the game itself.

It was SPORTSFRIENDS featuring Johann Sebastian Joust, and it was funded on 12/10/12. There's a listing for it in the OP. It looks like they're on track for a PS3 release this fall:

Mighty No. 9, a new side-scroller by Mega Man co-designer Keiji Inafune. They're asking for $900,000, but they're off to a good start.

Man, if they hit a stretch goal of a PS4 port, I'm totally in. That sounds cool, though I'm not a huge Mega Man fan. I did love, love, love Okami though.

I love Mega Man so this game is a no-brainer, but I can't justify spending $20 today for a game that might come out in 20 months. It's just shy of the original $900k now, so there's no reason for me to jump on at this point.
