Well there's a "tis-for-tat" back and forth on Spencer's and Ryna's emails on good, doesn't matter, don't care, blah, blah, blah....very little has been mentioned on what The Suits at Bethesda was saying....and appears they weren't too keen on all of it being taken in the M.s Family.....asking for the Exclusive Rights to a Game is one thing...but then buying the entire company to not only have them but future other games is totally different......personally alot out there probably wish bethesda just said no to both M.S and Sony and said we'll stay netrual and make games for everyone....but $7+ Billion is no laughing matter either...

The FTC's request for a preliminary injunction was denied, and they only have 3 days to appeal.

From the judge’s summary:
Given the way the preliminary injunction hearings went, this was the expected outcome. The FTC does not need to protect the market leader, and nothing in the facts of the case, nor in they way the FTC presented it, indicates that this merger would genuinely hurt consumers or the market.
That said, if MS were dumb enough to go back on their stated 10 year commitments, that would be more than enough reason to take them down in court.
Without an FTC appeal, the CMA in the UK remains as the only regulatory body that is blocking the merger. I can’t imagine how MS will work around that, though.
Microsoft's acquisition of Activision has been described as the largest in tech history. It deserves scrutiny. That scrutiny has paid off: Microsoft has committed in writing, in public, and in court to keep Call of Duty on PlayStation for 10 years on parity with Xbox. It made an agreement with Nintendo to bring Call of Duty to Switch. And it entered several agreements to for the first time bring Activision's content to several cloud gaming services. This Court's responsibility in this case is narrow. It is to decide if, notwithstanding these current circumstances, the merger should be halted—perhaps even terminated—pending resolution of the FTC administrative action. For the reasons explained, the Court finds the FTC has not shown a likelihood it will prevail on its claim this particular vertical merger in this specific industry may substantially lessen competition. To the contrary, the record evidence points to more consumer access to Call of Duty and other Activision content. The motion for a preliminary injunction is therefore DENIED.

If the FTC wasn't going to block the Ticketmaster-Live Nation merger, there probably isn't a single corporate merger they deem significant enough to block.

That said, Destiny (and the new Marathon) will be multiplatform, but that’s because Bungie apparently had a clause in their buyout agreement that they get to decide which games they make can be exclusive or not.
I’m curious to see how well a game like COD does on Switch and cloud services… since the UK CMA (the only remaining holdout, but new negotiations are coming, per a post last week) seems to primarily be concerned about the future of cloud gaming with this deal, and not much else.

Microsoft’s original deal offer to Sony in January 2022 included keeping “all existing Activision console titles on Sony, including future versions in the Call of Duty franchise or any other current Activision franchise on Sony through December 31st, 2027.” The deal terms have clearly changed since that opening offer, with an extension to 10 years that’s limited to just Call of Duty.

I disagree. The COD-only deal is better for Sony in the long run. I guess it depends how much weight you put on a single title, but yeah… time will tell.

Yeah, I bet CoD available for 10 more years on Playstation is more important to Sony than Spyro, Tony Hawk, Sekiro and CoD for the next 3-4.
And of course, negotiating this after the injection failed puts Sony in a much different and weaker negotiating position than before the case was heard in court.
