As I've said before, I would bet money that Microsoft will cut the price on the console before they cut the Kinect. They've invested too much into it to kill it like Sony did the Eye.
Who knows, at Gamescon they can announce a $399 price point while Major Nelson gives Sony the middle finger.

What exactly were you looking for from Sony. Is there something unclear to you? They have been consistent since June 11 and Shuhei Yoshida is killing it on Twitter. Also, in case you missed the irony, your entire list of new policies are already Sony's policies...except they sadly didn't get to fire Don Mattrick.

Yoshida's Twitter feed isn't creating headlines or getting Sony attention from media outlets. So, yes, they're still silent. Sony may have won E3, but they're not doing enough to maintain the lead while Microsoft is surprising and delighting every day.

They can take the hit on the price whereas Sony can't. That's the advantage Microsoft has, but I doubt they're willing to do that based upon the losses they've suffered this year already.

The only "won" E3 by saying their console plays used games and does not connect online, which are now irrelevant. They still do not really have any exciting launch titles, let alone anything announced for the future. MS on the other hand has 2-3 (Forza, Dead Rising, KI) big name day one exclusives, with even more announced (Halo, Kinect Sports, Titanfall)

A distinction without a difference.
I'll grant that all this flailing around is getting MS a lot of press, but I think you're overestimating how good it is for the brand and how much it penetrates outside of the enthusiast press. From a corporate perspective, it looks like they don't know what they are doing. Unless your position is that this was all some kind of guerrilla marketing strategy from the start, there is no way to spin all of this into a good thing. It is absolutely a good thing for Xbox gamers though. 
Meanwhile, Sony hasn't had to change a single policy and have done nothing to upset consumers at any point. They can just sit back on their big pile of upcoming game announcements, unless you think the four (maybe five) teams at Naughty Dog and SSM have no plans for PS4. Most importantly, they were FCC certified on July 23 and are presumably in full production. You know who's ultimately going to win this year? Whoever can produce more units and get them to retail, because everything that isn't a WiiU will sell through.

While I am very happy with the kinect news, I'm still concerned about Microsoft doing a 180 a year or so after their new console is released in regards to the DRM, Kinect, etc.... Hey, it's M$ I'll have to buy at my own risk.

Microsoft, since E3, has done everything right and continues to surprise every day:
- Don Mattrick was fired.
- No more DRM on Xbox One titles.
- The console will now ship region free.
- The headset will be included with every console.
- The Kinect no longer has to be plugged in to the console for use.
- Most importantly, Microsoft is being direct and transparent with every ounce of news that comes out. Where's Sony? Oh, they're silent.
I am a bit surprised by the Sony silence, though, I wonder what they're targeting for announcements?
If, say, the Zapper or ROB were bundled in with every NES at launch for a higher price, would we have called that a win, or would they still be collecting dust shortly after launch? I realize that a light gun and a "robot" aren't the same as the Kinect, but at least the previous version left a lot of buyers remorse in a lot of people, myself included. We'll see how much time and care developers will put into Kinect-only functionality for cross platform games that's not directly paid for by Microsoft... after all, making one version of their game better than another version will just result in them cannibalizing sales from themselves, right? Why not just make them the same?

I'm saying both companies will sell every single unit they get to market this year. All of them. That seems to me like a very non-fanboy position to take.
Please tell me more about why MS would ask the FCC to sit on their certification, and a source for the 30-day bit would be nice as well.

I don't think we will ever really know (at least not anytime soon) whether what Sony announced at E3 is what they had planned all along - or if they had similar policies as MS set-up and quickly decided to change that after the poor reception MS got.

I also strongly suspect announcements from some combination of Naughty Dog, SSM, Media Molecule, and Housemarque at Gamescom, and the only Japanese game they've announced is Knack, so they'll have something for Tokyo as well.
Also, there is the small matter of $100, which was really why they won E3. DRM policies got them applause, but $399 put butts in seats.

Hell yeah... if they had similar policies to MS and they did not make consumers happy at all, you bet your booty they would do the opposite.... otherwise they should just go out of business.

Owners of the original Kinect on Xbox 360 had the ability to unplug the device, but that won't be the case with the ever-vigilant and always-listening Xbox One version, Corporate VP of Microsoft Studios Phil Spencer told Joystiq.
"Kinect has to be connected to Xbox One," Spencer said. "That, from a creator standpoint, I love, because I like to have a common platform that I can target."
Spencer did take the opportunity to note that just because Kinect is always connected now, it doesn't mean Xbox One games are going to integrate physical activity at every opportunity.
"What I'm seeing in the creation process is more subtle uses of Kinect. I think when Kinect first came out on 360 everybody felt if you weren't doing jumping jacks in the middle of the room it wasn't a Kinect game," he said, going on to describe various everyday uses, such as watching television, for the product.

I have to say, MS has done a great job of whittling down my list of objections. However, the $100 price difference for a toy I will never use, combined with the price hike in Xbox Live and putting everything behind the pay wall, makes me feel like waiting. I've been loving PS+ and see no reason to pay for MS as well. If, down the line, MS has a great collection of exclusives that are must owns, and a price drop or Kinect-less version comes out, I'll consider one.
