Yes, but the flaws don't afect everyone the same way. If you made up a system that cuts the ratings of everyone by 10% for every letter in the host's name, it would be a flawed system and it would be flawed for everyone, but it would affect Jay Leno less than it would affect Conan O'Brien, let alone Craig Ferguson or David Letterman.

If that's the funniest "bit" he's done in 7 months (it's certainly the one that's gotten the most press), no wonder he's having the show taken away from him.
(full disclosure: I've never watched Conan, on any show. That bit is the only thing I've ever seen him do. And it wasn't funny.)

he'll probably take a little from both Jay and Letterman. I think that's going to hurt more than paying him off. NBC was stupid to allow him to walk, fully knowing he could be siphoning off viewers from the very show he was just booted from.

So now the question is... who gets the Tonight Show when they finally pry it from Jay's cold, dead hands. To say NBC's bench is weak is an understatement. I don't see Fallon in position for it, and forget about Carson Daly. Will they go for an unknown like they did when Conan got Late Night? Don't see that happening either.

But wasnt NBC in a bind ? If they booted off Leno, he could do the same thing and take viewers away from Conan.

Which I guess would be more of an issue if not for that deal Leno made with the devil to ensure eternal life and right to host The Tonight Show.
