A California punk band has filed suit in San Diego federal court claiming the CBS reality competition "Rock Star: Supernova" stole its name.

The trademark infringement suit filed by bassist Art Mitchell, drummer Dave Collins and guitarist Jodey Lawrence says they have released four albums under the name Supernova since the trio's inception 1989, MTV.com reported.

The suit names rock veterans Tommy Lee, Jason Newsted and Gilby Clark -- the three members of CBS' Supernova who are seeking a lead singer via the reality competition -- along with Mark Burnett Productions, Rockstar Entertainment Inc. and CBS Broadcasting.

The original Supernova is seeking a jury trial along with the destruction of all "labels, signs, prints, packages, wrappers, containers, advertisements, electronic media and other materials bearing the Supernova mark," MTV.com said.

The trio -- still actively performing and getting ready to record a fifth album -- said punk rockers could wind up accidentally buying music and merchandise put out by the metal band of the same name.

LOS ANGELES - What happens when two Supernovas collide? Lawsuit. A Southern California rock band called Supernova has filed a complaint against Mark Burnett's CBS reality show "Rock Star: Supernova," saying it had the name first.

The complaint, filed June 27 in U.S. District Court, claiming unfair competition and trademark infringement, seeks to bar the show and its participants from using the Supernova name. It is also asks for compensatory and punitive damages.

"Our clients believe they have the superior right on the mark Supernova," the band's attorney, John Mizhir, told The Associated Press Tuesday, adding that the band "has a long-standing common-law trademark right to the mark."

The group first performed under the name Supernova in 1991, according to the lawsuit. The band released several singles and three full-length albums under the name, the lawsuit says.

The CBS show using the name first aired July 5. "Rock Star: Supernova" follows 15 contestants who aspire to become the lead singer of Supernova, a new rock band that includes former Motley Crue drummer Tommy Lee, former Guns N' Roses guitarist Gilby Clarke and former Metallica bassist Jason Newsted. The winner will tour with the band and appear on its album.

According to the lawsuit, representatives for Mark Burnett Productions ("Survivor," "The Apprentice") filed seven U.S. trademark applications for the name Supernova and two for "Rock Star: Supernova."

Gary Hecker, an attorney for Mark Burnett Productions, said the company has the legal right to the name.

"The complaint is without merit," he said.

Because the lawsuit has not yet been served, its defendants — Burnett, CBS, Lee, Clarke and Newsted — "do not have an obligation" to answer it, Hecker said.

Oh well. . .I must admit that while it was a terrible idea for Zayra to do the same song, she did it a bit better last night -- but she still should have gone home. It was obvious Jill had saved her ass even before the other 2 went.

I was able to watch the "mansion shows" at work yesterday (since I can't watch on dial-up at home). It makes the whole competition a lot more interesting. I actually started to feel a little sorry for Chris, seeing that he realized he had picked the wrong song with "Roxanne". The new arrangement seemed like a desperate necessity, as there was no way he could sing it the "original" way.

Eh, the order of voting off right now isn't a big deal. If not this week, the weak ones will go next soon. I'm more offended that a song like that Tonic song ever made it out of someone's bedroom and onto the radio (barf).

why doesn't the band just find a lead singer and go out on their own? i guarantee they'd be 100x better than whatever-the-hell supernova will come up with.

does anyone know if the auditions process began before they even had a band lined up? I am wondering if these guys had any say in who is on the show?

I'm not super impressed with anyone this year, last year's batch of folks were much more interesting and talented. In fact, I bet a lot of those people were more suited for Supernova than INXS.

Glad Chris got the boot. He doesn't quite have the chops to pull this off. If anything he reminds me of a too-smooth, second-stringer a group has to get when the big guy leaves. Why start out with a guy like that?

Frankly none of the women are going to get the job done. Dilana looks like she's either ready for Intervention or a repeat performance on Cops. That one guy with that Stevie Wonder type-melisma is good, I don't think he's right either...

i feel like i knew the performers better last year, with the "in-house" shows. the reality part. i need to watch the online ones.

zayra is awful. look, i know she's foreign, so that's obviously the reason why she does this... but she is too stilted in her singing. while phil can't enunciate worth crap, she enunciates TOO MUCH. every phrase is so stilted.

chris' tonic performance was actually good. but he has two big front teeth, and he was lisping through it.

i couldn't believe jill came out in that getup for the hole song. the band doesn't want courtney love as their lead singer. don't try to be courtney love.

newstead is really good on this show. he has legitimate things to say. tommy lee is a douche. like with lukas, newstead was legitmately trying to make him better. and tommy says "shut up." what a douche.

gilby seems a little overly critical, but at least he can form complete sentences, and sounds reasonably intelligent. tommy lee probably only has 2 brain cells left, maybe 3.

ha ha, that's true.

ok, i'm watching the reality shows now, and right off the bat in the first show, it shows the band in the studio, jamming, with all the singers looking on. so it seems like they may have some idea as to what the band will sound like.

edit to add: then they all get a chance to lay down some vocals (that they came up with) on that track. chris volunteered first, and was decent. jill went, and did really well. then zayra went, and she was AWFUL. her lyrics were "This is the way we rock and roll, baby". gilby said he totally wasn't feeling it. everybody else was good. then ryan just decided he didn't want to sing. WTF? he said he wanted to differentiate himself. huh?

I think everyone there knows that Zayra, Jenny, Dana, and Ryan are the next to go, so why not keep Zayra around for a little while. I think she's reality TV gold!!!

I also agree with someone's early assumption that they've already picked a winner, and planted them on the show. I suspected that INXS did that with J.D. from the first episode. Final four for this season will be Toby, Lukas, Magni, and Dilana. I think Magni and his Icelandic band are already signed to a US contract on either Supernova's label, or one of the guy's in the band has a connection through their agent/management.

Interesting. I'm a fan of the oiginal Supernova and have 3 of their albums. I was just remarking to my wife that it was off that I hadn't heard anything about them breaking up OR making a stink about some other band trying to steal their name.

I would have thought that the network would have made sure that the band's name wasn't an issue before televising the show.

Reece would not elaborate on the reasons behind the split. Former Baywatch star Electra and former Red Hot Chili Peppers guitarist Navarro documented their 2003 wedding on MTV's Til Death Do Us Part: Carmen & Dave. The sexy pair met on a blind date, and "it was love at first sight," Electra told The Associated Press during an interview in 2004.

Navarro currently co-hosts the CBS talent competition Rock Star.

Yep. Separated since last summer. She has also been with David Charvet since then too, but I think they split also.
