i'm not Eric, but I think he was stating a hypothetical situation, in which case, he should have used the word someone in place of you.

I'm sure you guys are sick of this thread by now, but I had to update with this bit of news. I spoke with a person at Universal regarding returning the movie to them... He tells me I have to take it back to where I bought it...BIG SURPRISE THERE HUH? ...So that's not all, I get home today and in my mail is a letter confirming me as the 4th place winner in the Visa/BestBuy.com shop on us sweepstakes!!! Isn't that something? I am not making this up! It doesn't say on the letter what 4th prize is though.. Does anyone remember this contest? It says they will mail it in 6-8 weeks.

Congrats on your luck w/ the Visa thing, but back to the topic ..

What you need to do is take it to the next level. That means you go back to the store (I know, yet another trip) and demand to know the name of that store's regional manager and how to contact him or her. You have every right to that information and if the store manager refuses e-mail me. I may have another way of finding that out for you.

Regardless of how you get the info, you obviously need to go above that store's management team.

Or you can just treat yourself to a little five-finger discount and then set the place on fire. That's the fun way at least.

By the way, I didn't really pay attention in consumer-ed class but I swear I remember reading something that said any store is legally required to refund or replace anything they sell if it's defective in any way. Is that true? And if so wouldn't that apply to this situation? I'd just tell them I'd take legal action if they don't replace it, and then, as somebody above said, they'd probably just give you one to avoid the trouble.

Best Buy absolutely SUCKS BABOON ASS when it comes to customer service anyways. If it weren't for their fairly good prices and cool selection of electronics and gadgest, I would never shop there.

not to drag this on but I would find out who the District mgr. I would then continue to write letters to them also to the regional mgr.

Find out where their corporate office is too. I would also check with the Better Business Bureau on what your legal rights are as a consumer.

Good Luck man. Congrats on the contest too.

That's weird, I shopped at that same Best Buy in Lakewood, got a Mariah Carey DVD that was cracked and tried to exchange it. When I went back they didn't have any Mariah Carey DVD's and so I asked them to exchange it for a Pearl Jam DVD. After a lot of arguing and the Customer Service guy giving me a hard time, they finally agreed to exchange it, although he emphasized to me that this was a one time only thing and that they never take back anything that is opened. That is really stupid since you won't know if there is anything wrong with the disk unless you open it. Anyways, they should of let you exchange it, I can't understand why they are being such a-holes. Good luck.

P.S. What are in Long Beach do you live? Just curious since I live in the same city.

I once bought a CD at Best Buy and when I got home I realized the tabs that hold the CD in place were broken. I went back, showed the service rep the problem, & she told me to go get a new one. I think the problem with this DVD is that it's completely missing, not broken, or with defective packaging. But they should still take the return, if only to keep you as a customer.

Your not far from Ken Crane's, why don't you shop there. There selection is awesome, offer 30% and if something like this happened they would have replaced it with no problems. Just a suggestion. If you wanna know where there located, it's on the north side of the 405 on Beach Blvd.

Don't do this this, then someone else buys it and they have the same problems you are in right now. Imagine some family anticipating watching the movie and they open it up at 7:00 and find it empty. Their 6 year old son is crushed and now mom or dad has to go back to the store to try to exchange it. As sh$tty as it is of Best Buy to do this, do not just make it someone elses problem.

Try finding a friend that works for a record, game, or rental store and have them rewrap it. If your thinking this is a weird idea, keep in mind that some of the games, dvd's and cd's have been previously used. All they do is just rewrap and throw a new price tag on it and throw it back on the shelf. Ever notice the used tapes and dvd at Hollywood or Blockbuster are wrapped, hmmm, I wonder how that happened. Anyways, I would try that and return the dvd for store credit and repurchase the dvd title. If you don't have a friend in any of these kind of stores, chum up to your local video stores employees, never know you might be able to slip them a $5 and they'll do it. Just an idea and I know it works. <HR>

why not go to Suncoast or some other store, say you got it as a gift, and just want a new one? Open it there, and you're good to go.

I know it doesn't help with the Best Buy stuff, but I avoid Best Buy like the plague anyway.

How about you go in with the defective disk in case, go to the shelf, pick up a sealed movie leave the defective disk, go to customer service and exchange the sealed one for another sealed one. Tell them it was the wrong version or what not. The defective one is not sealed so no one would buy it, and you get your movie.

I live near that particular Best Buy and have encountered their "customers first" Customer service desk personnel. A bunch of wise ass punks.
Definately get the name of the people giving you the hard time and then get the number to their distict manager. you'd be surprised at just how fast the management team at ANY store reverses their hard assed by the book rules and starts kissing your arse once their district or regiojal manager is involved. It simply translates to shitty customer service.
To a district manager it boils down to "why piss off a potential lifelong customer over $20.00 when we stand to gain hundreds off this person if we keep him satisfied."
I'd like to hear more. I would also like to give my 2 cents to these nimrods over in that store. As i've said, i've had my share of troubles there. Nothing like you though. I once brought back a DVD player that refused to play using the remote control play button. you literally had to go push the play button on the device itself. Of course about 3 customer service clerks and a loss prevention guy were all huddled around trying to prove me wrong and ridicule my stupidity. After 15 minutes of trying to embarass me and force me to take my player back home and after snapping at them that "it doesn't matter if it works or not, I DON'T WANT IT", they finally conceeded that I was right. Bunch of idiots.

I have good news to report! Best Buy corporate was finally able to shake down the Lakewood store. The General Manager said they would exchange it for me "Just this one time" (As if, I would want to go through this mess again?) So, I went there after work, and sure enough they allowed me to exchange. When I brought them the new disc, I asked the girl at the counter to open it for me. Not taking any chances here! She said the Manager wanted her to put the new disc into my old box. I guess that was their way of giving me the shake down I appreciate everyones suggestions. I documented all of the names, dates, and times for my letter to BB corporate. I am not going to lie and say that I am never going to shop there again, because their prices are really good these days. However, I am not leaving the register with a sealed package, that's for darn sure! Thanks again folks!
