Businesses play favorites - they may make a different decision on something based on the value of the customer, prior history, attitude when speaking with the rep, etc.
Business can also be affected by the "who ya know's". If you know the sales clerk at an electronics store/car dealership/etc, they are more likely to "cut you a deal" that they wouldnt normally offer to regular customers.
Business can also be affected by which rep you get, one rep may offer you a great deal on an item, but the next rep wouldnt even get close(good rep vs. bad rep, at least in our eyes)... That's just the way business is.
Its not uniform, almost anywhere you go you will notice that.

I've had a lot of dimwitted bosses, but he's not.
It was just an off the cuff opinion, and I didn't go into the way some people were getting letters saying their cards would not be charged. It was just a response to the idea of a misprice on the Internet. He did admit he could be wrong (our office is mostly probate/trusts/family law) but I would take the opinion of someone who has actually passed the bar over the general consensus of dvd enthusiasts.
And of course he said "likely." You can never know for sure how things will go. Another atty on this website said he thought Amazon would lose--it's rarely cut and dried; if it were, we wouldn't need lawyers at all.
Edit: I asked another lawyer at work, and he too said he thought Amazon would prevail. His admittedly off the cuff answer was that if the agreement was 2 for 1, it didn't matter if the total page totaled the order incorrectly.

DId you relate to him their stated policy on the website, viz.:
"With respect to items sold by Amazon.com, we cannot confirm the price of an item until you order; however, we do NOT charge your credit card until after your order has entered the shipping process. Despite our best efforts, a small number of the items in our catalog may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation."
"With respect to items sold by Amazon.com, we cannot confirm the price of an item until you order; however, we do NOT charge your credit card until after your order has entered the shipping process. Despite our best efforts, a small number of the items in our catalog may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation."

I'm not sure if any policy that describes mispriced items would apply to items that were priced correctly but which had an incorrect promotion applied.
Everybody keeps talking about B&Ms which have incorrect sticker prices on items but this seems to be more of a case of the item being tagged correctly but a coupon causing the total to come up wrong (like a $10 off coupon turning into a $100 off coupon). What would a B&M's legal recourse be if that were the case (and you had already left the store with the item and the charge had already hit your credit card)?
All my paperwork has the correct prices next to the items. It's the "promotion" that was applied at the bottom of the invoice that Amazon is saying is incorrect.

Since the latest email stated that all returns have to be processed by them by 02/02, then that should mean that nothing should happen until tomorrow at the earliest.

I haven't been charged, but I cancled the debit card I used along with the account it belonged to. Now Amazon doesn't have any way to charge me besides sending to collections (which wouldn't shock me).
They told me that I was allowed to keep one order, because their terms of the promotion stated something along the lines of "promotion will be applied only items placed in one order". The way it is written leads you to believe that you have to have both items in the same order instead of single item orders to get the discount. They spun that around to mean you were only allowed to use the promotion one time. Hence I get to keep one order.
