Then call them about it. They don't have screwing over customers for their mistakes as a policy like some other named-after-a-river store seems to have.

Anyone ever wonder what would happen if something like this didn't get posted to a forum? Would they honor it if only a few dozen people ordered it versus a few thousand?

We are talking about Amazon ..... I dunno . I ordered the AirBud 3 pack and Im still not sure if it was a error but I got it for much cheaper than Ive seen it and Amazon shipped it . I guess it wasnt such a popular title plus it was still near 50 bucks . I think I got it for like 40 and change shipped after coupon . I seriously doubt Amazon would honor this even if a few people ordered it as it is a LOOOOOONG way to October .

Same thing happened to me from that fiasco . I just emailed them back before Gladiator released and they sent me a email saying "They were researching it" . A week or so went by and they sent me a 20 buck GC and a "Sorry we messed up" . I used it to pre-order Gladiator and had to spend like 3 bucks out of pocket for shipping . Then weeks later , I get a email saying they had shipped Gladiator for a total of 15 bucks . They had a "sale" on Gladiator and gave free shipping . I was even more floored when I saw that I had 5 dollars in credit in my account for the difference . They even shipped me the Dusk to Dawn 3 pack they price-mistaked even though I had to do alot of work to get the credits right and got lucky my bank refunded some charges from the entire transaction . Over all Ive been happy with BB.com . Im waiting for another blow-out sale after Thanksgiving to order more stuff
Id rather order from BB.com like I did last year than attempt to find a copy of the sale items at 6am

Cancellations are rollin' in....

As far as Best Buy is concerned - don't get me going about the From Dusk Till Dawn fiasco. They sent me only the first movie, and the receipt showed a different title altogether. That was a fun one to try and return...

And I never did get the trilogy out of the deal.

I guess the good old days of getting box sets for cheap prices is over.
At least I got in on the Extreme DVD 4 pk and Jack Ryan 3 pk sets a few years back from AMAZON and the FDTD from BESTBUY.

Just called them on and and had them cancel it. I told them I was really inconvenienced by the price change and that it was a gift for a friend so they are sending me a $10 gift certificate. My girlfriend did the same thing and they are sending her one too.

I'm not no legal eagle but it seems to me, that if a vendor offers a product for sale at a specific price, a buyer accepts that price then places an order and finally the seller puts in writing a confirmation of said order you then have a contract. Any lawyers out there that care to comment on my theory?

rkaufmann - your theory has been argued to death in this forum and others, on pretty much every misprice thread to date. What it comes down to is the fact that the merchant states clearly in their policy that they have the right to change their prices and that they are not responsible for honoring typographical errors. If the price goes up, they won't charge you without your permission. Likewise, if it drops they are supposed to refund you the difference without your having to ask for it (yeah, right! watch yourselves on this one - I've gotten many $5 - $10 credits as a result of post-order price drops, particularly when it turns out I've ordered their last stock of a particular item...)

Ultimately, though, it is the merchant's choice whether to piss off their customers by sticking to their policy, or make people happy but possibly/probably take a HUGE loss for it. Some companies go one way, others go the other. With Amazon it has become touch and go - they will probably give you a gift certificate if you ask for one, but otherwise they won't do much. The last unsolicited GC I got from Amazon was the Viking RAM fiasco a few months back, and I have to admit that the whole thing surprised me greatly. Anyway, my $0.02 has inflated, so I'll be on my way now...

This Amazon pricing policy disclaimer is really BS. A contract should exist and be enforceable once the confirmation email arrives. Amazon's pricing difficulties with just the dvds has been too many and too frequent. The FTC should crack down more on the internet companies just to get them to create better price controls to prevent such errors. You may think the FTC is giving the big named companies like Amazon some slack since internet businesses are still kind of new to the average consumer.

I do believe Amazon's errors are a form of modern bait and switch because while so many orders are being placed that Amazon item is then advertised as a big mover and shaker or as a featured product because of the many orders placed. Because it is a gift set it is 10 times more expensive than it was originally priced erroneously. Amazon may then be able to get some of the customers to confirm the order at the much higher price or send them a $10 GC hoping that they will repurchase the same item at a modest discount.

This reminds me of the recent "60 Minutes" program about the high schooler who purchased penny stocks and then advertised his thoughts about the stock over various internet forums and chat rooms to help promote the company stock in hopes of inflating the stock price and then cashing in. This kid made millions and then the government cracked down on him and made him pay back some of his earnings. I think this was on "60 Minutes" last week.


It just kind of stinks to me. The Classic Monster Set and now this set. Both have been around for a long time even though it was listed as a preorder.

You know, I'm currently consulting to some big-time class-action lawyers. You wouldn't believe the stuff they are suing over. They currently have hundreds of suits going, even a couple against Microsoft. However, they're really computer/internet illiterate and I know they don't have a clue what's going on with Amazon.

I'll talk to them next week about this stuff. If there's any tiny scent of blood in the water, trust me, they will pursue it. And they'll be advertising everywhere looking for plaintiffs who have been damaged. This might be fun!

I ordered the Monster Set and canceled it. I really hoped to get it but com'on... A class action law suit over a stupid misprice...?

This is a consistent pattern of behavior, not a one, two, or three time thing. Anyway, it won't hurt to ask. You've heard of spilling hot coffee on yourself, haven't you?

Even if they did charge your card - they can always refund the charge later if they decide not to ship. In my experience, they charged my card for an item for a couple of days, decided the price on the item was error, offered it at regular price while offering a $10 gift certificate (regardless of if I ordered) because of the error. I think the gift certificate was only given if your credit card was charged though.

Agreed !

To think that Amazon has to honour a mistake that will cost them thousands of dollars is ridiculous. How do you think they would make up for such a loss ? ....... Right, by charging us a little more on everything else.

Class Action Suit --- only in America would someone persue such a thing. The legal system needs some change IMHO

did you call them or did you send an email? if an email what address did you send it to?
