Spawn was a different idea. A demon general in a sense that came back from hell on a false promise with powers that would eventually run out turning him into hells super solider. The suit was alive, but that's like saying you can't have a sidekick.
Though, I'm sure if Marvel really wanted to, at the time they could have sued him. McFarlane isn't new to lawsuits. But at the time the image founders were new to publishing comics and a lot of their characters could have been subject to lawsuit if Marvel wasn't actually in the shithole finicially around that time.

not just a rumor anymore? reports are coming in that FX artist Tim Phoenix has said that the crew is in the conceptual design process for the villains, who are Man-Wolf and Venom.

If the do go with Venom, I wouldn't expect him to be the "alien" suit from the comics. That would probably pull too much of a sci-fi element to the show that would confuse audiences or damage the suspension of disbelief.
What they would probably do is just have Venom be more of an anti-Spided-Man, with most of it being Brock's obsession with Peter Parker. Maybe have the Venom symbiote be some kind of by-product of the original radioactive spiders that bit Peter or some kind of out of control genetic experiment from Harry/Oscorp.
(Just like, if the do "Dark Phoenix" in X-Men they would probably leave the Imperial Guard out of it.)

They should do this movie a la Kill Bill style if Venom is the villain. Film a longer story to show the origin of the alien suit, Peter discarding it then Eddie Brock getting it, then chop it up into two parts, release one in the beginning of the summer and one at the end. First part is the origin of the suit and the ending of that one could be peter ditching the suit. The next part could be Eddie getting the suit and the hilarity that ensues! They'd make a killing.

If i were to rationalize, there's the potential here, with the GG and man wolf, assuming both aren't mr. church, that the frequently desired 'two part venom' movie to actually develop.
we already have psychological relationships established between peter/spidey and both osborne and JJJ. with nothing going on, the eddie brock relationship could emerge and he could without him ever really becoming venom til the very end and still have a decent movie.
man wolf is a different kind of villain than GG and doc ock, but not too out there. (throwing spiderman into secret wars or a fight with juggernatu and his magical armor i think'd be sooooo poorly received by non fanboys)
it's so fun to speculate, lets just have a new verison of the sinister six and be done with it.
unless they make infiinity gauntlet

i want to see some spiderFRIENDS in this one. why must all the supers be baddies except for peter?
