why wouldn't you have returned the headset as a step one as opposed to buying another controller?
My 360 is a December 05 build date with the original controller. I followed these steps
1.) Turn On 360
2.) Turn On Controller
3.) Turn On Headset
4.) Hit sync button on 360
5.) Hit sync button on Headset
6.) Continue 360 use as normal.
Haven't had an issue since. I don't know what the problem with yours is/was but I wouldn't have considered replacing my controller as an obvious choice.

I've had a lot of problems with mine too. I would not recommend it at this point until M$ fixes them. You can read over at Xbox forums and see this is an issue and they are working on a fix. They have sent out test models to some people.
Buying a new controller helped with some issues. I don't get ppl complaining about the buzzing, and hissing any longer, but the synching is still an issue, just not as bad as before.

Yeah exactly, I don't get it either. But I don't like to talk to people during games so I won't be getting one regardless.

dude- if you can, just return it, these units are JUNK, and M$ refuses to admit it.
you will be fighting w/ that thing for as long as you own it.
pick up some of these instead:

you will be quite happy. yes they are big/bulky, but they sound sweet!
game sound & voice through the headset.

..just a few more notes on these turtle beach headsets,
-you'll probably run into some negative reviews on this unit,
i did when i was researching, but figured, i'd try them first hand.
picked them up walmart, incase i needed to return them, no questions asked.
since i've owned them, -they've worked flawlessly. the range is decent (but who's sitting 20+ feet from their tv). one thing is that you do have follow the installation instructions, exactly. they arent rocket science, but just make sure all the connections are correct.
also, you'll need to "balance" out the sound options for each of your games...
and your xbox settings.
i had to lower the music, and turn up the voice for GOW,
so they do need a little tweaking, but no big deal.
when i'm on xbox live, no issues...people can hear me just fine.
they are a very good solution, when it comes to a headset,
they really work for me cause most of the time i miss out on game audio
(kids) and i cant crank up the surround sound.

Slightly better price on the Turtle Beach ones at NewEgg.
