Talking about that (and sorry for straying a little off topic) after reading Jan's assessment of Michael, the D-M attorney asked Michael something along the lines of, "Would you say Jan has poor judgement?" Wouldn't any decent lawyer object to that question? No matter how Michael answered it, he was screwing someone. If he said yes, he was screwing Jan. If he said no, he was screwing himself.

Anyone know the answer?

I'm too junior in my firm to have actually done depos, so my knowledge is more from training and law school, so I may not be completely accurate on procedures, but I'll explain as best I can.

A deposition is part of the process of discovery, where you provide evidence in your possession to the other side, and both sides make their witnesses available so that the lawyers can prepare their cases. So at a depo, Jan's lawyer who is presenting Michael as a witness would not actually question him at a deposition.

When a lawyer objects to a question at the depo, the objection is ordinarily made for the record, and, unless the other side withdraws it or rephrases it, the witness answers the question. At a trial, the judge would be present and rule on the objection, and the witness giving an answer to certain questions could confuse or prejudice the jury. Since there is no jury at a depo, whether an answer would be prejudicial is not an issue.

If the question would violate a privilege, then the defending attorney may instruct the witness not to answer it. Sometimes if things get really nasty, the lawyers will yell at each other, and if the questioning is really confrontational and the deposing lawyers are being really egregious, the defending lawyer will take his witness and walk out of the deposition, but when those kinds of fights break out, the parties have to go explain that to the judge.

I think, if a lawyer had an aggressive style, it would have been a good idea to get up in the other guy's face when the DM lawyer pulled out the Jamaica photo, and I think even a fairly mild-mannered lawyer would have had to make some noise when they tried to show Michael that evaluation. Although I get that, for the joke to work, obviously the lawyers have to play straight to Michael.

At a trial, I'd object to that question because Michael doesn't really have the expertise to evaluate Jan's professional judgment, and his assessment or opinion would be irrelevant and prejudicial. At a depo, though, the objection would be noted and I'd instruct him to answer the question.

I too have begun using that's what she said in daily conversation. And in some really bad situations.

We were moving to a new data center last night. At one point, we have this massive, 7 1/2 foot tall Dell rack, roughly half loaded and weighing around 1,000 pounds, tilted, trying to get it through a doorway. Despite my lone voice of reason, it was decided unracking the servers would be way too time consuming. There are 6 of us giving ourselves hernias trying to get it through the doorway. Our stoutest guy is about to throw his back out trying to right this thing. He shouts, "PUSH IT BACK IN AND HELP ME GET IT UP!"

How the hell does one let that opening slip away?

Through gritted teeth, I yell back, "THAT'S WHAT SHE SAID!" One of the guys on my side that was helping to push it down proceeds to walk away laughing his ass off. We drop the server rack back down instead of gently sitting it down. I thought my stout co-worker was going to bust a gut. He told me to never, ever say that again when he has 700 pounds looming over him.

i can't think of any better time to say it than that. not only does it fit perfectly, but there weas even a risk of bodily harm. Michael Scott would be proud.

In watching the rerun tonight, Pam definitely has had a boob job or she's preggers. Those things are huge lately. Any word?

I don't know about that but I think that Pam looks WAY better this year than she has in any of the previous seasons. That's saying a lot because I always thought she was cute. In any event, she looked great this season.

I doubt she's had a boob job. I think it's just that the clothes they're dressing her in recently are more flattering to her figure. Considering her back injury, when would she have had the surgery? And also, considering her recent split with her husband, it seems unlikely that she is pregnant.

She sure does look good, but I've thought that every season.

The NBC Universal Store has sold more than 150,000and countingDwight Schrute Bobbleheads, modeled after the character portrayed by Rainn Wilson. In honor of this milestone, two very special bobbleheads autographed by Wilson will be available online for "The Office" fans to win. One hundred percent of the bobblehead auction's net proceeds will go to Wilson's charity of choice, the Mona Foundation, which supports children's education projects throughout the world.
