I was thinking something along those lines. He also held his hand up to his ear and said "What?" when Charlie was talking to him. At the time I thought he was trying to be cute, but in retrospect maybe he really couldn't hear him.

Really, honestly...attaching rules to a Purgatory scenario? Come on, if they want to have surgery, it can be passed off as one of the steps towards salvation or the like. If they want to explain shooting other people, you can call it a "soul struggling against passing on." The rules go out the window...kind of like a train station with no exit (Matrix). I was simply pointing out that Purgatory is back on the table.

It's funny. I really felt that this episode should really put an end to the purgatory theories for good. Mostly because, if they were in purgatory, then the writers wouldn't give such a huge clue pointing to it at this point in the series. Where else do they go from here? How do you write for dead characters when the viewers know they are dead? It takes away much of the gravity of what is happening. "Oh! It doesn't matter if they get shot. It just means they're going to heaven."

It just smells too much like a red herring.

I still maintain the writers are laughing their asses off at the moment, knowing that that one line was going to get all the purgatory theorists out of hiding again, when they are really planning a complete 180.

Don't Kate and Sawyer know that the Others set them up to have sex in the cage? That could be considered attempted murder on Kate. She's gonna be pissed!

If that's indeed what they did, it's not attempted murder. It's another case for Juliet to try and find a cure for this thing.

I just rewatched the scene where Juliet leaves Ben a message. To make sure I heard what I thought she said, and she says:

"...I'm still working on getting samples from the other women. I should have Austin's soon. I'll report back when I know more."

So, she's not after just Kate, she's looking at all of the women.

There are places that hold trying to give somebody AIDS can be considered attempted murder (given, usually by statute). If we consider that attempted murder, it seems this would fall right in with that logic.

AND didn't Ben make a comment something like 'that was unexpected' or something like that when he walked up behind Jack while he was viewing it?

Yeah, but I think that was more a snide comment, kind of like, "Gee, how ever did that happen???"

I thought the snideness was more for Jack's benefit; but that he had been suprised by it (Didn't he see them together prior to Jack witnessing it?)

Wasn't it all a setup though? IIRC, Jack woke up or something and the door to his "cell" was open...he went out, wandering around, and just happened to come across a surveillance room where Kate and Sawyer could be seen together, and this is ultimately what pushed Jack over the edge to do the surgery for Ben. I think.

That's how I remember it. He set it up to manipulate Jack.

Just to clear up the debate:

They're NOT in purgatory and they're NOT dead. Why am I sure? Because Damon Lindelof says so!
