DO NOT ORDER from Djangos.com!!!!

They have just fraudulently ripped me off by charging me for products that never arrived!

Worse is the attitude of the sales person there. Here is the excerpt of my e-mail commmunication with them:

I am EXTREMELY irate by this. First, they have NOT shipped my product which they have already charged me for. Worse, the customer service even dares to MOCK the customer! Needless to say, I am reporting this immediately as a fraudulent charge by Djangos.com. I would advice everyone to not shop here. I also don't think that Geoff should go on supporting them by having links to their site, as others may very well be ripped off by them as well. However, that is up to Geoff to decide upon.

People, be VERY aware of the type of business practice this company is using.

(Same topic as the one written on Online Bargains board. I'm trying to make people aware of their unscrupulous tactics.)

They have now agreed to credit me back for the unreceived CDs, after I threatened to report them as a fraudulent business.

I shall be watching my credit card balance very carefully in the near future. I am still very wary of their practice, especially after such an incident. Needless to say, I won't be shopping there again!

I have never had any problems whatsoever with them...I believe I have ordered three separate times from them and each time I received the merchandise in a timely manner....I guess you had a bad experience but I seriously doubt that Geoff is going to tell people to stay away from this store. This is actually the first complaint I have read about this store.....In the future, if you have already contacted a store regarding items not received and they fail to do anything then that is when you call your credit card company and lodge your complaint!!! It will turn out in your favor...believe me!!!

I've placed 7 orders with them with no problem. Yours probably got lost in the mail or someone in your neighborhood is listening to Love Me Do!
Anyway good luck getting this mess straighten out and don't give up on them. I think they wanted to make sure you didn't receive any of the CDs whereas they send alot of them out seperately!

This is not my first order either. I've never had any problems on my two previous orders from them.....until now. Considering that I'm not even a new customer, I find it insulting that they would even consider me as trying to lie my way so I can get, what, three used CDs for free????? That's ludicrous!

As you say towards the end there, the CDs were either never shipped or were lost, that much is obvious. But for some reason you're leaping to the conclusion that we have a 'never shipped' scenario on our hands ('they have NOT shipped my product') and I'm trying to find out why.

Unless there's some missing evidence somewhere, you appear to be going way, way overboard in labelling them 'fraudulent'.

Look, as long as I never received the product I have paid for, the transaction is not completed. If the transaction is not completed, they have a responsibility to finish it, or give me my money back. However, the fact that the sales person tried to mock me instead and did not finish the transaction or pay me back means that they have VIOLATED the agreement.

Here is a line from my law book:

"If the seller is the merchant, the risk of loss does NOT pass to the buyer until the goods are received."

I have never received the goods. Thus, the merchant is violating the contract. This is a breach of contract. Okay, I should not have used the word "fraud", because fraud implies a misrepresentation by one of the parties. However, the legality of this is plainly clear: the merchant has the responsibility to rectify the situation, not I. The fact that the merchant mocked me and did not give me proper compensation means that they are breaching the contract and breaking the law.

Of course, after I threatened to report them, the guy was very quick to say that they will give me my credit back. I shall look very carefully to see if they do so or not.

Maybe they shipped by UPS? I have had a couple things shipped from CD-now that took about 3 weeks to get to me. As for credit back, it was probably Bull$H1+, I would contact your CC if it doesnt show up soon.

They only ship by special mail(which is like First Class) at this time....I called and ask....how else do you think they get by with only charging $1.99 for shipping??? They say they are working on alternative methods for the future.

I didn't notice anyone mocking you. First he asked "none of the cd's right." You didn't understand what he was asking, so he clarified "you didn't get any of the order, right?" In what way is he mocking you? It sounds to me like he is trying to clarify the situation.

His responses were:

none of the cd's right
you didnt get any of the order right

Now, consider this: the CDs were sent in one shipment (as indicated in my first post). Since the shipment never arrived, exactly WHY would he ask me if some of the CDs actually arrived???

Plus, he did not have ANY question marks after his sentences (nor any punctuations and proper grammar, for that matter). I asked one of my co-workers to see what she thinks (I work in an office). She also said that it is clear that the person is mocking me. I'm sorry, but the way he phrases it does NOT sound like a question at all. Plus, why would he ask me a question that he should already know from the rest of the post?

whatever Cheeseman has to say in that book, unless he's quoting from elsewhere, isn't 'the law.' it may be good advice, but you wouldn't want to sue someone with only that...

For less than $20, you'd only end up at the petty courts. There's no "suing" involved. I've worked in a law firm, so I think I know *something* about business law. And sorry, but there has been enough precedence on cases where goods are not delivered as promise that it's obvious who wins. Believe me, I've looked at a LOT of cases on this. And if you're a lawyer, you should know this too.

that's nice. all i did was question the usefulness of Cheeseman as a decisive authority.

Yes, but I wasn't only relying on Mr. Cheeseman's "authority".

Anyways, I am glad to report that they have credited me back for the CDs that never arrived. I would have preferred it if I got the products (hence the reason why I paid for them in the first place!), but at least they did follow up on their commitment. I just wish that they could have done it better and saved me from all the aggravations that they had caused.
