Bartender claimed JT only had one drink. It doesn't matter when you refuse the sobriety test... instant fail.

I'm not sure I'd want to take a field sobriety test since they seem like they're very open to interpretation*, and breathalyzers can be inaccurate. Maybe you can't request a blood draw, but in my head, that's always what I thought would be the thing to. Maybe not, though.

* One part of some tests is to stand on one leg for 30 seconds. I can't do that sober and I probably couldn't do it drunk either.

Doesn't matter in NY. Failure to submit is equal to the full DWI charge.

I googled (it's on the internet so it must be true!) and several law firms for NY recommend not taking the field sobriety test but taking the breathalyzer. I wonder if you fail a breathalyzer if you can request a blood draw for verification that the test was accurate. One thing that complicates all of this is they're not just looking for alcohol.

I was referring to the breathalyzer test refusal not the 'on scene walk in a straight line type of test'. Sorry for any confusion.

When I was younger, I could do stuff like stand on one leg or walk a straight line heel-to-toe with no problem even if I was shitfaced. Tried it several times when I was in college (NOT during a traffic stops I want to emphasize) and I suspect most young people could do these things easily even while intoxicated, but older people would struggle with them even while fully sober. Even standing on one leg for thirty seconds could be difficult for people with even mild arthritis, or if they're overweight.

But the whole point of the field sobriety test is just to let cops fuck with you.

while I am by no means making excuses for him, imagine a life where getting arrested for this makes headlines everywhere and spawns threads on obscure sites like DVDTalk. I envy the wealth, but not the notoriety.

It’s suspended as long as the court case is going on. His lawyer is still claiming he was not intoxicated and the case should be dismissed. Whether he was or wasn’t is irrelevant as he refused the breathalyzer.

Failure to submit to the breathalyzer results in license suspension, not FST. Nobody should EVER agree to take a FST, sober or not.
