This Is A Bootleg Right?

Got it in the mail today from ebay for $6.24 shipped, no inserts were included, im thinking this is a bootleg version because i have never seen this dvd cover for 50 first dates..
seller was reputable too..

is it a bootleg? and should i leave a neg, or try to get my $ back if it is a bootleg?

Yes, that's a bootleg. The DVD-9 symbol pretty much tells you right there.
Contact the seller and arrange for a refund (especially if it was advertised as the R1 edition with the correct picture/UPC). If you get a refund, I definitely wouldn't neg, but a Neutral comment explaining that you received a bootleg but a prompt refund is appropriate... to warn other buyers.
If he refuses to refund, take it up with eBay/PayPal. You got an item that was materially different than advertsed.

Sorry, but that cover just screams Asian bootleg. 
You could probably get your money back, especially if you paid with Paypal and threatened to take it up with them. The guy probably gets away with it enough, selling to unknowledgeable buyers, that he can afford to not make waves and give refunds to the few people that actually call him on his merchandise.

I'm curious - do these bootleg discs look purple on the side that plays? (Like the standard blank discs you buy for your PC's DVD burner?) Or do these look like a genuine silver DVD? I assume the latter, but does that mean these Ebay power sellers have factory-quality DVD production equipment in their basement or something? Or do they just work as a middle man for someone operating out of Hong Kong? Please excuse my naivete'.

Just glancing through past auctions, it seems like the seller has nearly 100% bootlegs ("artwork different than picture", etc.)
Unbelievable that no one has called him on it via feedback within the past 6 months... I can't stand sellers like this. Makes eBay a shitty place to be -- for both buyers and (legit) sellers alike.

As soon as I see the DVD-9 symbol, I steer clear away. Even for sales of around $5, it doesn't hurt to email the seller -- if you have any suspicisons of it's authenticity -- and ask if it's a "genuine" R1.

I'm seeing a lot more "100% Genuine US-Retail, R1, Authentic! Not Asian Import"-type of descriptions. Which is good.

kornboy: Don't feel too bad; you're not alone. One of the Blockbusters in my area has bought 20+ similar discs...even though another store's manager told me they had been given handouts (with photos pointing out the DTS and DVD-9 cover markings) warning them about these Asian bootlegs.

I don't mean to knock the OP; fooled once, shame on the bootlegger, naturally. You should take a look around these forums for threads about "how to spot bootlegs on E-bay", because they have a lot of tips on key words and phrases to avoid before you buy, rather than having to go through this hassle after the fact.
Also, you should report him, though trying to get your money back first isn't a bad idea. Letting him continue to get away with it just because *you* got your money back isn't really the right thing to do. Obviously, there are a lot of people who are buying from him just like you did and not realizing it's a bootleg. (or maybe not caring.)

Yeah, I emailed him, and hes gonna give me a refund, here was his response..
I will be glad to give you a refund. Please send the DVD back to me. I purchased this DVD from ebay, I watched and it was fine. I described the dvd just as it was. I buy, watch and sell quite a few dvds. I do not know of there origin nor do I copy them.
