just out of curiosity, why does a uniform change equal a continuity problem?
I guess DS9 had one too then?

Might have more to do with the Spock near-smirk/smile than the uniforms. The all-out grin from "The Cage" would've been the better choice if that's what they're going for here.

Regarding the Expendability one, with Kirk, Spock, McCoy, and Redshirt Crewman, does anyone remember that episode? Did that poor shlub really not make it back to the ship?

It doesn't really, except that Where No Man Has Gone Before was filmed as the second pilot, and is generally accepted as occurring several months before the events of the rest of the first season did. When shown on TV though, it was aired third (after The Man Trap and Charlie X) so that created several uniform and staffing discrepancies.

The single disc DVDs of TOS keep the eps in production order so it's not a problem, but the season sets show them in airdate order, thus the continuity issue.

That looks like a shot from an early scene in the classic season 1 episode "Arena" (the one with the Gorn). The RedShirt is Ensign O'Herlihy, who does in fact, get killed.
