Are LAN-oriented programs safe from the RIAA (OurTunes/MyTunes?)

Hi.

There are programs going around like Ourtunes and Mytunes which allow you to download and stream songs from someone's itunes collection. Now this is only on a LAN network, thus I was thinking outside sources like the RIAA would never be able to tell what you were doing if it was on one of these programs.
am I correct in this assertion? Is it safe from the RIAA?

probably

safe from lawsuit if they found out?
proably not the way the riaa works
