Second Spin selling used items as new - repercussions?

Second Spin selling used items as new - repercussions?

Twice I've brought a dvd set into second spin for store credit, only to find it on the shelf the next day ticketed as new. Are there repercussions for this? I'm not going to confront them about it, because they are always cool to me, but I like to buy still sealed used items from them, and it seems the pool is getting smaller because they aren't putting them on the floor as used. I noticed when I would sell my laserdiscs back to Dave's Video in the 90's he would reshrinkwrap them and sell them as new as well.
