Being sued for unpaid medical bills

My wife was just notified that she is being sued for $830 worth of unpaid medical bills. What options are available to her to settle this out of court? Has anyone been in a situation like this before?

Options for settlement out of court: pay lawyers' fees and pay your bill

When I was 24 I tried to commit suicide and after I was released from the ER I spent 2 weeks in the psyche ward. The doctor who saw me checked a wrong box and had it down as a poisoning instead of a drug overdose so the insurance company wouldn't pay the $25 grand for the psyche ward visit. After three years of arguing and trying to explain to the hospital that if the doctor would just change the fuck up they would get paid. They wouldn't change it so they threatened to sue. I filed bankruptcy and they didn't get shit. Good luck with dealing with them.

That small amount I'm surprised it didn't just go to a collection agency.

There's a difference between getting sued and threatening to get sued. Re-read any correspondence you've received to make sure it's not just an empty threat, which collection agencies do.

I work in medical billing for a large hospital system out here and they wouldn't sue over what to them is a frivilous amount. It typically would have to accumulate in to the $1000s to make it worth while.

Smaller debts like that are sent off to collection agencies to attempt to either reconcile or to settle. Eventually, if enough time has passed, it will have been sold off to another collection agency as a junk debt. Sometimes amounts less than a grand are written off on our end -- so we wouldn't take someone to court over this.

I'd have your wife validate the debt with a letter to whoever is trying to collect it and start there. Just remember you're not acknowledging that the debt it yours, you just want proof that it is.

Also factor in how old this medical bill is.

If, for some reason they are trying to sue you for that amount, I'd be really shocked.

I will bet you they will settle for less. Trust me.
When I had my tumor removed I owed $80K and I had no insurance at the time so it went to collection.
They called me and said if I settle now that I would only owe $13K ... $80K down to $13K !!!

As for the "we will sue" bit, they aren't suing, they're trying to collect.
Make a payment plan of $20/month and be done with it.

Why even respond if you are not going to offer some type of useful information. Of course the OP knows to pay the bill. He doesn't need someone telling him that. He came here for advice, not some smart ass remarks.

What VHS said. Call them and ask for a discount. More than likely they'll offer something less, provided you can pay it. And if you can swing paying in one sum, see what they offer first, then counter and ask for a lower amount and offer to pay it right then.

Never call a collection agency to settle a debt. Do any correspondence in writing with a return receipt from the post office. They can make up whatever they want as they go along and if it's he-said she-said, you're SOL.

Basically this.

Don't forget that all of this goes on your credit report. Paying it, even if it is less than the full amount, is better then having it charged off as bad debt.

What I ended up doing was taking a low interest loan out of my retirement to pay all our hospital bills, because we had another $1,000 owed.
