So my wife and I have lived at the current apartment complex we're at now for the past three years. We also lived here previously for a period of a year. So that's four years at this place with the same manager.

She's in her mid 30's, one of those really by the book people. Never says anything to you if it doesn't concern your apartment. Not very friendly.

Anyhow, the rent is due at the latest by the 5th of every month. We always pay around the 30th or 31st of the previous month. We've never been late. In four years.

Until the other day.

So we call them up, say we're out of town (we were), and say we'll drop it off that night. She reminds us that it's late (duh) and that it's a $40 late fee. I admitted it was my fault, and asked if she could do a courtesy waive of the fee because it's the first time we've ever been late.

Here's how the conversation went down:

Me: I understand we're late, that's my fault. We went out of town, and it just slipped our mind.

Her: "That's not my problem. The rent is due by the 5th at 5:00pm. It's now the 6th."

Me: "Yeah, I know. I apologize. Is there any way we can have this waived? Just this one time as a courtesy?"

Her: "No. The rent is due by the 5th at 5:00pm."

Me: "I know that. I just thought maybe there was a way we can get it waived. I mean $40 isn't a lot of money but it's still $40."

Her: "The rent is due by the 5th at 5:00pm."

Me: "So there's nothing you can do?"

Her: "I really don't understand what you're asking here."

Me: "Well we were out of town, and ----

Her: "You should have mailed it."

Me: "Haven't you ever been in a situation where you know you were the one at fault but someone did you a favor and made an exception or let you slide?"

Her: "No. When I am late for something I pay the late fee."

Me: "So never in your life have you ever asked for a fee to be waived or ----

Her: "This is getting ridiculous."

Me: "Okay, well is there any way I can talk to the owner of the property?"

Her: "He's not here in this building. I run the show."

Me: "Yeah I know he's not there. Can I get his phone number, maybe I can call him. He'll probably say the same thing you did but it's worth a shot."

Her: "This property is privately owned, and I cannot give you his number."

Me: "Okay, well can I have his address so maybe I can write a letter?"

Her: "No. This property is privately owned, and I cannot give you his address.

Me: "Okay, well I just thought you might want to be halpful, but I guess I was wrong."

At that point the call was over. We get this ridiculous "pay or quit" notice on our door for all to see like we're some deadbeats. I know I am in the wrong for forgetting to pay but it's not even about the money now.

Is there any rule that requires a manager to provide the contact info for the manager?

Sorry for the long post, I was just very surprised at how bitchy she was.

You can find the name and address of the owner(s) at your county recorder's office. Your county might even have a website at which you can pull this information, sometimes for a fee.

That said, IMHO it would be kind of a douche move to contact the owner over a $40 late fee that you clearly owe. That's one reason why people hire property management - to avoid having to deal with such issues.

exactly... she's a douche for not cutting you some slack, but you'd be a bigger douche to contact the owner of the property over $40.

You knew the rules in advance, and you broke them.
Quit looking for a bailout, take responsibility for your own actions, and pay the fee.
Chances are the penalty fee will help you remember to never let it happen again.

For what it's worth, I was once in the OP's shoes (been in my apt. seven years, never late, no issues of any kind), and I was across the country when I realized I was going to be a day late with my rent. I called the office as soon as I realized (day rent was due) and explained my situation and apologized, and they DID extend me that courtesy, so it's certainly not unreasonable to ask. And I think had she simply not been a bitch about the situation and said something to the effect of, "I'm sorry, but I can't waive the fee for you," this thread would not exist. As it is, if she's always bitchy and unfriendly to her tenants, the property owner should be contacted. It's possible they don't know, and the fact that she represents them in turn gives a negative impression of them and could certainly impact whether good residents choose to stay or move. Empty apartments cost money to paint and clean and don't generate revenue when unoccupied, and resident satisfaction and retention should certainly be part of her job.

FedEx delivers overnight for $15, that's cheaper than $40. You do, of course, need to remember that you forgot the day before so you have time to mail it. And you say it's not about the money, but it is. Without the money, you wouldn't have created this thread.

Keep in mind this is her job. They make regular trips to the bank to deposit rent checks, so if she makes a special trip for your late check, the owner might ask her why she didn't charge a late fee. In general, apartment managers don't grow up wanting to do that job, so they don't have much motivation to help you out. I forgot to sign a rent check once, but the manager was nice and didn't charge me a late fee. I would have, because that seems like an easy (and very lame) excuse.

I'd give a friend you trust a check to hold on to. If you ever forget again, ask your friend to drop the check off. Even if you buy them a $40 dinner, at least you can watch them eat it. If you must feel like you got $40 in value from this, move the fridge and punch the wall behind it. They never look there.

I don't think there's any harm in asking for the courtesy, but when you kept pressing the issue after she clearly said no I can't really fault her for turning bitchy.

I'd suggest increasing your rent payment by $1 each month. Then if this happens in another 4 years, you're covered.

As others have said, no harm in asking. Once it was made clear she wouldn't budge, yeah, just pull the troops back into the foxhole.

When it's time to move, pay her the same courtesy and ensure it's all done by the book on their part.

I've contested a ticket before. I bet half the people on this board have, including you. It's not like I was calling the cops about it like that guy that dialed 911 about his burger being wrong.

You guys are brutal. Trust me, it's not even about the money. I paid the money before I created this thread. It's her attitude and her unwillingness to provide me some information.

What if she'd said "fuck you, pay your late fees and stop bitching."

I guess I should have just walked out and said "you sure told me."
