Jennifer Lopez has to pay license fee to imitate Flashdance

What is up with this? If she'd made a parody she wouldn't have this hassle. The Simpsons, Saturday Night Live and dozens of other shows and movies imitate, parody, and saterize famous scenes from movies, they don't have to pay a license fee.
Jennifer Lopez has acknowledged that her dance number in her new video "I'm Glad" uses the same routine that appeared in the "What a Feeling" sequence in the 1983 movie Flashdance, starring Jennifer Beals. Responding to a legal notice sent by Paramount Pictures to Sony, whose Epic Records company produced the video, a spokeswoman for Lopez said Wednesday that the dance was intended to pay tribute to the movie. A Paramount spokeswoman told reporters Wednesday that Sony has agreed to pay a licensing fee for use of the routine.

Parodies are protected under free speach, plagarizing is not (or at least not for civil lawsuits) I tend to agree its stupid, but whenever artists start pullling out "well it was a tribute" you know they are in trouble legally.

I also wanted to add that (contrary to the folks at Paramount who clearly know nothing about their own films) the music video was not "frame for frame" identical. For one thing J-Lo didn't do the breakdancing moves that the original Flashdance audition scene had (hell, she didn't even wear the same costume!)

According to Good Day Live she did ask Jennifer Beals to borrow the outfit that was used in the movie. Apparently they had to expand some parts to accomodate Jennifer's assets..

I can appreciate that you guys don't like Jennifer Lopez, I'm not much of a fan myself. but the point of this thread is that I can't believe the record co. had to pay a royalty on a parody. I think it's BS.

Doesn't have anything to do with Jenny or licensing fees...but i'm surprised that Em has that much control over Weird Al's parodies..

NEW YORK (AP) - Eminem may poke fun at himself in videos, but he doesn't want "Weird Al'' Yankovic doing it.
Eminem won't give Yankovic permission to shoot a video for his new song, "Couch Potato,'' a parody of Eminem's Oscar-winning tune "Lose Yourself,'' Yankovic said.
"The only reason I could glean was that making a Weird Al music video would detract from his legacy as a serious hip-hop artist,'' Yankovic said Thursday. "It's very disappointing. This could have been my best video ever.''
A representative for Eminem did not immediately return a call Friday.
Eminem parodies himself and other celebrities in some of his most famous videos, including "Without Me,'' where he depicts himself as a fat Elvis Presley.
Artists who have allowed Yankovic to parody their songs and videos over the years include Michael Jackson - whose hits "Beat It'' and "Bad,'' became "Eat It'' and "Fat'' - and Madonna, whose "Like a Virgin'' became "Like A Surgeon.''
Yankovic said the rapper allowed Yankovic to redo the theme song from the hit movie "8 Mile,'' but said he would need to hear the final mix before granting the video rights. After receiving the final version of the parody - which pokes fun at television addicts - the rapper's representatives said he would not allow a video.
"We started preproduction on (the video) already, because we just assumed that there wouldn't a problem,'' Yankovic said.
Yankovic said Eminem also refused to allow him to release the song as a commercial single. It's the first cut on his 11th album, "Poodle Hat,'' which also parodies songs by Avril Lavigne and rapper Nelly. It's due out May 20 on Way Moby/Volcano Records.
Although Yankovic says he's grateful to Eminem for allowing him to parody his song, he's still lamenting what would have been his "most ambitious'' video ever - heady words, coming from a man who dressed up like Jackson in a fat suit for the video "Fat.''
"You'll just have to listen to the song and close your eyes and imagine what might have been,'' chuckled Yankovic.

In the Eminem situation, he allowed Weird Al to do the song but not the video.
In the past, Weird Al has been accused of parodying a song without permission, as in the case with Coolio's "Gangsta's Paradise." (Personally, Coolio may not have agreed to the parody, but apparently his management did--probably with dollar signs in their eyes.)
I don't think Weird Al wants to be in that position again.

I mean, come on! Do you really want to live in a world where Stephen Sommers could simply reshoot The Good, the bad and the ugly with Brendan Fraser as Clint Eastwood, Mark Whalberg as Eli Wallach and Stephen Baldwin as Lee Van Cleef?
