They are appealing. From Tuesdays IMDb News:
As of now all marketing material (TV adds and website) says, "This film has not yet been rated"
Just three weeks before the release of his romantic sci-fier Solaris, director Steven Soderbergh (Traffic) is locked in a battle with the MPAA ratings board over its decision to rate the film R because of two scenes in which actor George Clooney is seen naked from the rear. Referring to the 1995 episode of NYPD Blue in which the naked backside of Dennis Franz was displayed, Soderbergh told today's (Tuesday) Los Angeles Times: "Believe me, there is nothing here that is worse that what has been on NYPD Blue." Soderbergh said that he plans to appeal the rating.

I believe there's also a few shots of Uranus, which also upset the MPAA.

Jackass..R...extreme gross out real stuff.
Rules of Attraction NC-17 for violence,sex,drug use,language.Though it's all simulated & most left up to the imagination & not shown graphically!
Solaris..R...butt shot....the horror!!!
Robin Hood:Prince of Thieves...PG-13....strong intense violence,rape..& some nudity.
Are any of these actually consistent?

Anyone else think the MPAA is getting EXTREMELY blue-nosed?
Just saying that in the past, movies rated PG-13 have included nudity -- "European Vacation" had several shots of topless women and "The Woman in Red" had a scene of full-frontal female nudity.
I often get the feeling if certain of episodes of some broadcast television shows were submitted to the MPAA -- like "NYPD Blue," "CSI," or "X-Files -- they would receive R ratings.
