It's funny that this is coming up 2 years after the fact due to a bumped thread. However...

The "Notes" section on the deposit certificate is specifically referring to getting a refund on an unredeemed certificate, to the amount of the $5 deposit. As you had apparently already used the certificate for purchasing a steelbook, nothing in that notes field applied to you.

You opened the steelbook, and as far as I know, Best Buy isn't supposed to do refunds on opened items. What's worse, is that you returned it without everything it came with; notably an unused $50 gift card. If you included the drained gift card in the return, then you were clearly aiming to deceive the return department, who likely couldn't easily verify whether the gift card was used or not. The $50 gift card was for the person who bought and owned that steelbook, and your right to use it was forfeit the moment you decided to return the steelbook.

Just because you got away with it doesn't mean you didn't do anything unethical.

Re: Lord of The Rings on Blu-Ray in 2010!

You dont know how to read

1. Specifically referring to an unredeemed certificate? Yeah right, it clearly shows the word "redeem" refers to the "trilogy set" not the empty steelbook

2. Yes, I opened it - but it doesnt constitute opening the steelbook is non refundable. Take note, on the mechanics of the rules - its about the "receipt" not the steelbook

3. Are you creating new rules for the $50 certificate? thats funny... trying to be defensive on something you have no clue.

Dude, for info - after presenting my evidence to American Express, with no doubt my right as a consumer and my understanding about the Law are all done in legal matters.

Now that youre creating a new set of rules (based from your ridiculous understanding) I suggest, go back to consumer 101.

Unless, youre a Best Buy associate in profession and cannot withstand consumers like me?

P.S. - Define "Unethical"? Are you telling me youre understanding is "right" and "just" and you are better than Bestbuy, SideShow Collectibles and American Express? - All I can say, your understanding about legality is Narcissistic in nature (funny)...

I just followed the all the set rules and my consumer rights were granted back by three business establishments - Best Buy, Side Show Collectibles and American Express. All of which were processed to a proper documentations, receipts and by law.

My bad. It's been several years, so I didn't realize/remember that the steelbook was separate from the disc set.

I would say that you taking advantage of the gift card included in the steelbook constitutes it being non-refundable. Did you tell the Best Buy CS representative when returning it that you had used the $50 gift card that was included?

How was AMEX involved? You mentioned getting a partial refund as store credit, and then getting the rest charged back to your credit card. Did you initiate a chargeback with AMEX? What was the reasoning for Best Buy to only give you a partial credit. This was only over the $5 deposit, right?

I think in this instance, I have more facts on hand than any of those companies had, so my perspective is better than any of them, yes.

For Best Buy, they issued you the steelbook in the expectation of either you going through with the pre-order and purchasing the set when it came out, or returning the intact steelbook for a refund of your deposit. If Best Buy didn't fully refund you, then there must've been a good reason for doing so.

For SideShow Collectibles, they included the $50 gift card for those who pre-ordered and bought the full set. However, they had no way to verify before you used the card that you were going to go through with the preorder, so they were trusting that you and the majority of people wouldn't abuse it.

For AMEX, I'm still not sure how they're involved, but if you requested a chargeback of the balance that Best Buy didn't refund, then AMEX was likely depending on your being a honest customer in terms of your dealings with Best Buy. They likely favor trusting the customer over the merchant, and they pass the chargebacks onto the merchant, who has to pay for them.

Did you tell Best Buy or AMEX that you had used the $50 gift card inside the steelbook before returning it?

As a merchant, 95% of the time you get an AMEX chargeback, you're fucked. They almost always take the consumer's side, right or wrong.

Yes, Bestbuy is aware that I opened the steelbook so does Amex.

If you read my previous post (I marked the one in "Red" which is Damaged) - thats why it was "Opened"

And the reason why Amex got involved, Bestbuy gave me a "Gift Card" instead of the monetary credit card tender I paid.

What I did were:

- I kept the receipts
- I opened one steelbook (damaged one),
- I made use of the $50 Sideshow Collectibles gift card
- I bought 10 pieces of this figure stand

- I got myself some freebie swags from Sideshow mailed separately from my order

- I went back to Bestbuy with the slipcard of the opened LOTR preordered steelbook and requested refund (make sure to emphasize the "Notes" section)

- Got my refund back (one batch of the refund was credited as a store credit, the other batch was charged back to my credit card)

Insecure that I won the case, and you werent able to do it to yourself? I did not contort myself - I just did the proper way getting what is worth for me.

Funny, how you resurrected a 2 yr old thread Oh, for your enjoyment... see my other previous post related to it:

4. It was originally scheduled for release at March 7 until they moved it to March 2 of this yr.

5. Its an opposing side of availibility among various Bestbuy stores some were able to get a huge quantity of it while others were 0 availability.

6. The change of availibility resulted to major retraction from Bestbuy:

Spoiler:
Dear _ _ _ _,

Thank you for your recent Lord of the Rings Trilogy steelbook case (sku# 9794135) order on BestBuy.com.

Due to a system error the steelbook case appeared on our website before it was supposed to. As a result, your order will be canceled; however, it will be available starting on Sunday, March 7, 2010 where it will be part of a pre-order offer with the Blu-ray version of The Lord of the Rings Trilogy. The offer will work as follows: pre-order the Blu-ray version of The Lord of the Rings Trilogy and receive The Lord of the Rings Steelbook case for free. Note you must add both items into the Cart to receive this offer. If you are interested in this promotion please visit BestBuy.com this Sunday to place an order for this offer.

Please note there is a limited supply on the steelbook case so place your order early!

We are sorry for any inconvenience this may have caused.

Thank you for shopping at BestBuy.com,

7. I tried pre-ordering once again from the site, despite showing availability this is what showing at their system:

Spoiler:
1 Lord Of The Rings Trilogy Pre-Sell Steelbook - Blu-ray Disc units are not available at the store you have selected. Please return to your cart to reduce the quantity, select a different store or remove this product.

8. Strong susceptibility to Dent, Bubble, surface scratched or peeled (due to strong gumtype adhesive placed) - so if shipped huge chances it might be damaged.

9. You'll end up getting Trashed leftovers upon using the Sideshowcollectibles Giftcard.

10. Chances are for those who got a purchase pass of March 7 (upon not getting it last March 2) its a Hit & Miss (50/50) chances.

Oh well, its the enjoyment of Steelbook Hunting

That's not what I asked. I asked if they knew that you had used the $50 gift card that was included in the packaging.

From what I read, it sound like you knew it was damaged before you opened it, so there was no need to open it, except for you to use the $50 gift card before returning it.

So Best Buy gave you a $5 gift card, and then you complained to AMEX to get the full $5 chargeback? Did you return the Best Buy gift card then?

Case? I don't even know what you're talking about.

You spent the gift card and returned the rest of the contents for a refund. The end.

Right. You decided (through some self-serving convolutions of your mind) that you were entitled to the gift card, despite being issued a full refund for the product, so you took the card and are now trying to justify it by elaborating on and on about all the reasons you disliked the product. Well, you received recompense for your dissatisfaction with the product in the form of a full refund of your purchase. Of course, you didn't seem to have any problem with the gift card part of the product.

Funny how I didn't.

Funny how you think it would be relevant if I did.

Funny how you seem to imply there's a statute of limitations on bragging about theft.

There's NO reason to bump this thread. If another discussion on the Blu-ray set is needed, WITHOUT arguing about theft, then feel free to start a new thread. Thank you.
