The most encouraging aspect of the pricing for me personally is that you can actually find pretty good bargains on this stuff. I don't think I've paid more than $20 total for any of the 10 HD-DVDs I've purchased. Between the 10% Amazon deal and google checkout, I've been getting these movies for about $15 off retail. Not to mention the outstanding deal for the Toshiba HD-DVD player from Continental One Pass Miles for Merchandise, I'm not sure how long I can hold off from having 2 players. I actually would like to have a BD player at some point, but the $1k cost is just way too much to justify what else I could have with the difference.

Yes... and the itWire author seems to be going out of his way to attribute them incorrectly. The lack of a link/cite seems particularly obvious.

Josh -- can you sue? Probably. Actually, if you know a lawyer who would take a peek at this, it may be worth it, just to get him to take it down.

I'm not aware of what legal rights you have here, but I'm pretty sure that you (and Geoff) do have some.

You had posted on the avs thread discussing it, so you should know.

Nowhere in the ITWire post did he claim to be referencing the ZDNet blog. He provides no attribution whatsoever. He merely quotes words that I've written and claims they're from a Microsoft employee.

So if someone could please post a link to the thread that discusses it,I would appreciate it.

There might be something about it in this thread from AVS. Wasn't too hard to find. Just had to do an advanced search.

There are threads popping up over there in the BD and HD forums almost daily. Not too hard to find at all.

In order to bring suit, one would need to prove damages. It is hard to see what, if any, monetary damages Josh may have suffered as the result of this idiot's "article." Besides, the imbecile does not even attribute the quote to Josh by name so that probably guts any libel cause of action. Not worth much more than a letter or email to the site demanding a correction of what is obviously an intentional misattribution (the guy waved the "microsoft employee" flag in practically every other sentence in that "article.")

Again, now vs. later. Yawn. Your analysis presumes BD's existence years from now.

I think Josh/Geoff have a case, not for libel but for copyright infringement/plagerism. I am sure the author of a work can stop distribution by unauthorized oarties, especially when uncredited.

I'm not really going to sue, but I would like a retraction and apology. I posted a response on that page and emailed the editor. We'll see what happens.

bboisvert 07-17-06 07:13 PM

Josh -- have you made Geoff aware of the situation also? I'm not sure what your agreement is with the site, but Geoff may literally be the owner of those words. I'm sure he'd be a bit concerned about this article misrepresenting his site. And taking text without permission or attribution.

I've said it before, but it bears repeating. Your reviews of both HD-DVD and Blu-ray have been the best I have read so far. They are heads-and-tails above other things I've seen, both on the net and in 'legitimate' print media.

Qui Gon Jim 07-17-06 07:26 PM

I read/skimmed five other articles on that site, and four of five were very anti-MS. Now I am not MS's #1 fan, but to accuse anyone of bias on a site like that one reeks of hypocricy.

Adam Tyner 07-17-06 07:28 PM

The article's been "corrected", but it still makes assumptions of Josh's review based on a couple of excerpts rather than the review in total, still accuses him of "FUD", and refers to him at one point as "the Mr Zyber".

I find the new version quite amusing. By adding in all of the corrections, it completely invalidates the entire point of the post.

Thanks, hmm strangely I had a BB employee rave about HD hddvd when they had it on demo. I wonder if I should go inquire about i it tomorrow since I have the day off?

It would be interesting to see if they really are trying to 'push' it and are purposely being misleading or just plain clueless.

Ive been to BB numerous times since BD was released. No one has tried to push it on me AND one time, when I asked where it was, the guy said that it wasnt out yet. He came back a few minutes later and corrected himself then pointed me to it.

this might have been asked but if HD-DVD were to become the prevailent HiDef DVD format - what would happen with BluRay and specifically: would the Sony/Columbia TriStar titles revert to HD-DVD?

uhh...I wouldn't plan on it in the next 5 years. ;)

I dont think its gonna happen any time soon. But, if HD-DVD just takes off and puts alot of distance between itself and BD, I think Sony would eventually break down and sell HD-DVD discs.

They arent gonna hold a grudge, they are in this to make money. If HD-DVD will make them alot of money, they will switch. Besides, Sony has gotten good at having to change course after a failed format. ;)

darkside 07-18-06 09:02 AM

Sony has too much at stake. They will not support HD DVD until there is no life left in Blu-ray. I would honestly never expect there to be Sony content in HD DVD.

I think it also depends on if hd-dvd becomes THE next format. If BD dies, but hd-dvd is the equivalent of laser disc, you are probably right.

If its the next DVD, then Sony will support it.

So shut up. If you don't care, your opinion is useless, by your own admission. So shut the fuck up. Some of us care, and we are the ones discussing it.

And frankly, video doesn't matter to you people, either. I've seen mouthy J6P setups. Doesn't matter if they have a 40" or a 100" TV, all they really see is the size, not the quality.

"The PS3 relies on a feature [Blu-ray] that can't be utilized without equipment [an HD television] that sells for double the PS3 itself. Sony is hoping the PS3 will be carried by a feature that will go almost unused by the time the PS3 is replaced by the PS4. "

While I think that HDTV sales are rising faster than most people realize and predict, this is a very interesting point. HDTVs will certainly not be "mainstream" any time in the next few years... and although your average PS3 buyer is more likely than not to either have one or want to buy one soon, does it make sense to put so much faith in that?

... but it won't.

Remember that Blu-Ray train is indestructible.

With the latest release of hit Disney/Miramax films, there's no stopping the Force of Blu!!!!! rotfl
