Late Wednesday night, AACS agreed to an Interim agreement so that Blu-Ray and HD-DVD production could stay on track for their initial release plans. That interim agreement can be read here:

My understanding of the situation is that Toshiba, since they are launching first, has said they will be offering firmware upgrades to further cover the full scope of AACS.

I'm surprised AACS is still such a mess after all this time.
