Is there some sort of evil cap on uploading for roadrunner users?

I know it is slower to upload than download, but I have gotten sustaineed 350k\s down, but can never get over 40k\s up (though usually around 30-35)! Why is it capped like that?

So you don't host a web or ftp site that will get a lot of traffic. You can do only so much downloading, or data transfer, since it depends on your keystrokes. Millions of people hitting your site can do much more data transfer. They want you to pay big for that.
