Wouldn't be bad to check out. Assuming it is in English.

Oh, I'm sure there'd be *some* french-speaking person who'd been ripped off by DVDsoon who'd be thrilled to translate.

Not me, of course. I live on the West Coast. Here we get confused when the boxes are stacked the wrong way forward on the shelves.

They can interview english people too. They will translate after. They did that in the past. You can send a Email to Dominique and let him know what's the situation for you, how much money they own you. Let's do this together, things will go faster.

Does anyone have an update for the TV consumer spot...?

On a side note, does anyone else notice that you can't order anything with your ipoints? Even though I have done the small chargebacks for my unshipped items and will never order anything from them again, I am trying to get some of the freebies that I can get from them using the ipoints, if they will ever allow them to be used.... Just to add salt to the wound... However, I don't have any hope that this will happen...

Thought some of you might like to know that ANZ VISA credited my card for un-delivered dvds.

Good news.

To everyone who has initiated a chargeback recently, expect an eMail like this very soon:
Dear Sir;

I have verified and your account was placed on hold by the legal
department. They have recently received a charge back request from your
credit card company and are presently investigating the situation. If
you have any further information that will help us with our
investigation please do contact us once again. We thank you for your
co-operation.

Has anyone actually placed new orders with their credit just to see if they actually have items in stock now?

Maybe they should consult their legal department on the legality of taking people's monies, cancelling the order, and refusing to give a refund....

Considering that you have to spend more money just to use the credit to buy anything, I doubt anyone's foolish enough to try...

I would tend to agree with that statement, although you never know... there's probably SOMEONE out there who reordered.

They now have a form you can fill out to request your refund:

Under account on left bar click refund request:

DVDSoon.com credit refunds will be issued in the form of cheques that will be sent to you by mail.

In order to obtain a credit refund, please read the following procedure:

You must fill out the form below before October 31st, 2005. All requests posted after this date will not be eligible for a credit refund.

On Noverber 1st, 2005, credits that were available in your DVDSoon account will be withdrawn to issue your cheque. Therefore, even if you have requested a credit refund, you may still use your credits and we will credit the difference.

Please note that it may take 6-8 weeks to process, treat and send your request and cheque, starting from November 1st, 2005.

Europeans are not likely to be able to cash those cheques, is my experience.
Anyway, there might not be any cash left behind by that time at DVDSLOW....

Why not refunding through my creditcard?
Seems like another smokescreen...

Sounds almost like 11/01 is the date that they are planning to go bye bye. If you're really cynical and suspicious....

I don't see any way that DVDSoon survives this mess. The PR damage alone must have cut their business by 80-90%. The level of incompetence that they have shown in trying to stay afloat is staggering.

Has anyone noticed they have made some changes to their "Terms of Use" again.

In order to offer you the best service...
When purchasing on the DVDSoon.com web site, you accept the following rules:
DVDSoon.com can add to or modify the rules at any time. However, the rules applicable will always be those in effect at the closing of the contract.
The sale is closed once the products ordered are shipped.
The word price in the text means the price of the products and the applicable taxes. The word credit in the text means an amount of money redeemable for merchandise at DVDSoon.com.

Sales Policy
Please remember that e-commerce is an exceptional field in the world of business. Laws and legislations concerning this sector of activity have not been completely nor fully developped and defined.
The price and the shipping fees are charged at the moment the transaction is completed , meaning, when you click on "Confirm Purchase".

So they've gone back to charging when you order again?

I don't think so as the language: "Please note that full payment (which includes total for the items and total shipping fees) is charged to your credit card at the moment the products are shipped" is still there. I think they mean the charge is set at DVD Soon's price and (maybe) at the exchange rate at the time of purchase, regardless of when the charge is actually made to your credit card at shipping. But they are doing their typical piss-poor job of communicating. Maybe it's lost in translation. Maybe they need someone whose first language is English to translate from French which I assume is the language this stuff is originally written in.

The whole quote about charging at the time of purchase is:

The price and the shipping fees are charged at the moment the transaction is completed, meaning, when you click on "Confirm Purchase". This is done so that you pay the price at the moment of the transaction and not of another time, so you can preserve your savings.

I filled out the form and now the three month wait begins.

I'm not holding my breath.

I would say any cheque issued by these guys won't be worth the paper it's written on.

Unless you have tried and failed to get a chargeback through your credit card, I wouldn't even fill out this form. I'm sure it's a ploy they'll use to refute the chargeback by saying you've already agreed to wait for a cheque.
