ebay question
 
I bought something at ebay and paid through paypal.

When it arrived, it wasn't as advertised.

I contacted the seller about a refund but he is dragging his feet.

Do I have any way of getting my money back?

Yah. File a complaint with Paypal within 4 weeks. If not, you're screwed.

If you used a credit card through paypal to transfer funds, you should be protected, as I was when I bought a camcorder that never showed up.

You can also file through ebay as well and you'd have to do that within 4 weeks also.

What exactly was not advertised? It has to be a pretty clear cut case of wrongdoing on the part of the seller in order to get any action done.

I bought a pair of shimano 105 STI shifters. He advertised them as "brand new" and with "no scratches or blemishes".

One of them looked brand new, but the other lookes used and had several scratches and blemishes on it. If I knew the condition of this item, I wouldn't have bid so high.

Keep in mind that Paypal does not protect the buyer against the quality of merchandise. As long as the seller can prove with online delivery confirmation that they shipped you something -- anything -- within 7 days to your confirmed address, they will find in favor of the seller.

Your best bet is a credit card charge back (if you didn't use an instant transfer).

After 30 days, you can also file an online fraud report with eBay.

You may also file a fraud report with USPS.

Its going to be pretty tough to remedy this situation. As I said before it has to be pretty clear cut (wrong item sent, nothing sent) for Ebay or paypal to do anything. I would recommend some of the avenues mentioned but I would chalk this up to experience and leave negative feedback.
