No, it's DC's fault, for letting their trademark lapse.

And they could still use the name after that, just not print it on the cover.

That's a different Captain Marvel. Marvel and DC both have characters called Captain Marvel.

Paramount and Universal didn't have any creative input in the films, they were just the distributors. Even as part of Disney now, by all accounts they pretty much let Marvel Studios run itself.
