The Element of Crime was one of the very first Criterion dvds I ever bought back in the early 2000s. I still haven't watched it.

Almost all of them are under Disney control. Anderson obviously has/had some deal to have his films go to Criterion, but who knows how or if that applies to 4k.

Criterion has been pretty open about the fact that they aren't going to release everything on 4k. Maybe that will change, but for now it's just the reality.

And them not playing the upgrade game...

Eh. That sort of thing happens all the time with Criterion's website. The difference I think is that the announcements were delayed a day and the info was probably sitting there hidden on the site...

The director's cut for Blood Simple has been the default version of that movie for 20+ years. I could be wrong, but I don't think the theatrical cut has been seen since VHS.

They have almost always deferred to the wishes of the filmmakers and seem to involve them whenever possible. There's a certain virtue in that, but as we all know it can also go horribly wrong.
