Um, National Comics (later DC Comics) actually sued Fawcett Comics on the claim that Captain Marvel violated their Superman copyright in a case that ran for over a decade. Fawcett settled the case...

Probably more of a case in not having faith in Warners than DC, which is kind of justified when you look at how they handle their DC properties.
