Do people really believe that whatever marriage arrangement Trump/Melania have, that it includes some sort of fidelity clause?

I'm 99.9% sure that Trump can boink anyone he likes and that Melania "signed up" knowing/agreeing to all that.

There are three elements to a contract: offer, acceptance, and performance. If I give you $1,000 and an unsigned agreement, but you never do anything to indicate you've accepted it, then it's not a valid contract. I can probably successfully sue you to get my $1,000 back, but not the contract.

With Trump and Stormy, it looks a lot like a contract was formed. He offered her $130,000 in exchange for her silence, she accepted, he performed (gave her the money).

But there are wrinkles.

First, he's trying to have it both ways, claiming there was never any contract between Trump and Stormy. If that's the case, then he's denying there was an offer, and we have no contract. It's a weird scenario I've never seen play out quite like this, so who knows how it would shake out if he actually tried to sue her for breaching the NDA.

Second, there's a thing called the Statute of Frauds. Every state has its own version, but the basic rule is that any contract that can't be performed in a year must be in writing. There's also typically a maximum value (any contract for more than $X must be in writing). So you and I can have a handshake deal that I'll give you $50 and you'll give me your autographed copy of Fire and Fury. If I give you the $50, you can't weasel out by saying we never signed a contract. But if I give you $50 in exchange for a promise that in 2020, you'll give me your autographed copy of the book, we can't do that on a handshake under the traditional Statute of Frauds. This NDA is probably within the Statute of Frauds, meaning if it's not a written contract, it's probably not enforceable. Unsigned means not a written contract.

Third, contracts get breached all the time. Let's say you and I have a signed contract where I will sell you 1,000 widgets at a price of $10 each. And lets say someone else comes along and says "I will buy all your widgets for $30 each." I can decide to sell that guy all my widgets. You can sue me. If the contract doesn't have what's called a liquidated damages clause, you'll get your $10,000 back, but that's it. Maybe we added a liquidated damages clause -- a clause that specifies what the damages will be if I breach. In that case, we'll follow that -- as long as it's not punitive. So we might agree on a liquidated damages clause of $20 per widget, because without the widgets, you can't sell your cool gizmo and you expected to make $10 profit. We probably can't agree that if I breach our $10,000 contract, you're entitled to $25 million in damages. No court will enforce that. All of which is to say, depending on what the contract says, if Stormy's willing to give up the $130,000, there's only so much Trump can do to keep her from talking.

He came out said the Russians were responsible for poisoning that guy in the UK and his daughter, and he's immediately shitcanned. When I saw that on the news yesterday, I wondered how Trump would respond. Now we know.

The President of the United States and the Republican party have been compromised by a hostile foreign power. There's really no way around it. Trump is a traitor and the entire GOP is enabling him.
