Senator Bob Menendezís corruption trial

This trial was brought up in another thread because of missing party affiliation.

Senator Bob Menendez apparently had a high end lifestyle from bribes funded by a $105M Medicare fraud scheme.

The first day shows a rousing start.



The defense asked the court to recess the trial to allow Sen. Menendez to return to the Senate for votes, and they had an interesting response in their answer (Nope!) -

"United States Senator can try to hide behind the very office he corrupted to avoid accountability to the public for his actions"

This judge has done an incredible job in guaranteeing Menedez an appeal in the first day of the trial. He completely lacks the demeanor to be on the bench and is using his position to make a name for himself, not conduct a fair trial.

Nowhere. The amendment says, "the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense." Fairness doesn't enter into it.

Which has been interpreted as the right to a fair trial. Fairness enters into every single one of those stipulations.

If you want to think of it that way then fine, although people here seem to be complaining about the judge (I haven't seen and so can offer no opinion), which specially seems not to be covered by the amendment. From everything I have read of this case, Menendez was completely corrupt, even if there was no direct legislative quid pro quo, which the McDonnell cases seemingly establishes as the circumstance needed for conviction. It seems almost an impossibly high standard for prosecutors. I hope Menendez goes to prison, but I don't see it happening. The best that can be hoped for is a complete fall from grace and him being drummed out of politics for the rest of his life.

Menendez says the gifts were just kindnesses from a wealthy pal, and that the aid he extended Melgen was nothing more than a senator doing his job. His defense has gone so far as to claim the case is an ďattackĒ on a culture of generosity among Hispanic-Americans.
Disgusting tripe. Menendez failed to report the gifts to the public on disclosure forms, strongly suggesting he thought he had something to hide. And the timing linking Melgenís gifts to Menendezís actions could hardly be more suspicious.

Two donations totaling $60,000 to Menendez-supporting campaign committees were promptly followed by Menendez meeting with a State Department official to try resolving a business dispute involving a Melgen-owned company in the Dominican Republic.
Two $300,000 contributions from Melgenís company to the Menendez-allied Majority PAC were followed by a Menendez meeting at the Centers for Medicare & Medicaid Services to get a reimbursement formula changed in a manner that would enrich Melgen.
Meanwhile, Menendez allegedly intervened to help obtain travel visas for Melgenís girlfriends, who hailed from Ukraine, Brazil and the Dominican Republic.
Conviction or no conviction, Menendezís conduct violates the public trust; had he more decency, he would have stepped down long ago.
This trial has been a long time coming and held up for years - I am surprised that Menendez hasn't resigned.

Menendez is innocent until proven guilty. He's got every right to hold on until he is convicted and his appeals are exhausted.

Practically speaking, I expect that if he is convicted, he will resign once Chris Christie's successor takes office.

No son, I don't think that way, I know that way. You are completely wrong, and it's not an opinion. The considerations in the amendment go directly to the concepts of fundamental fairness. And that's it. Take a course on constitutional law and then try to argue differently.

Sebelius' Testimony at the Menendez Corruption Trial



Robert Menendezí corruption trial heard from former HHS Secretary Kathleen Sebelius, who testified to getting pulled into an ďunusualĒ meeting on a topic that she purposefully had avoided.

So why did Sebelius end up taking the meeting?

Harry Reid

ďIt was unusual for Senator Reid to ask me to come to a meeting involving another member of Congress,Ē she said. ďI think this was the only time in five and a half years that that occurred.Ē

What also made the meeting different, Ms. Sebelius added, was the topic. ďI was asked to discuss a practice involving a billing issue before Medicare and Medicaid services,íí she said. ďThat was not something that I was personally involved in on a basis like this.Ē

Ms. Sebelius indicated that she believed the issue had to do with the billing dispute facing Dr. Melgen, since she recalled that Mr. Menendez had tried to contact her by telephone at some point in the 12 months before Mr. Reid reached out to schedule the meeting.

ďSenator Menendez had made a call to my office asking that I return the call on his cellphone,Ē Ms. Sebelius said. When she asked her aides why the senator was trying to reach her, they told her about Dr. Melgenís billing issue involving the Centers for Medicare and Medicaid Services and that Mr. Menendez had been inquiring about it. ďThey recommended strongly that I let someone else in the department return the call and that I not return the call,Ē she said.

Menendez judge denies motion to acquit, trial turns to defense's case

A federal judge in Newark denied Sen. Bob Menendez's attempt to toss out the Justice Department's bribery case against him Monday morning.

After initially offering a willingness to consider a motion to dismiss by Menendezí defense team of all charges relating to bribery, Judge William Walls issued a resounding denial this morning -

The federal jury weighing Sen. Bob Menendezís fate deliberated quietly for six hours Tuesday, emerging only to ask a question Ė one that struck observers as odd.

Can you define a senator? the panel of seven women and five men asked U.S. District Judge William H. Walls. Walls opted not to give the jurors the answer they sought ó and also denied their request to have portions of the defenseís closing arguments read back to them. Instead the judge instructed jurors to rely on their memories of earlier court proceedings and reminded them that what the lawyers said was not evidence in the case.

For his part, Menendez, too, spent most of the first full day of deliberations cloistered behind closed doors. He emerged briefly toward the end of the day to chat with a crowd of supporters in the courtroom.

The New Jersey Democrat has denied allegations that he accepted lavish gifts including free flights and luxurious hotel stays from a Florida eye doctor, Salomon Melgen, in exchange for pressuring federal officials to make policy decisions on his benefactorís behalf.

Menendez has argued that the gifts were nothing more than exchanges between friends and that his advocacy was based on sound policy views, even if it was Melgen who brought the issues to the senatorís attention.

The jury is expected to resume deliberations Wednesday.
