Steve King: Cluck you, chickens and Californians!

House OKs bill that would limit California's egg law at LATimes.com

California passed a law that requires imported eggs to come from farms with chicken cages large enough to permit a chicken to:
  • lie down
  • stand up
  • fully extend his or her limbs
  • turn around freely

Iowa Congressman Steve King is trying to nullify California's law. (Never mind states' rights.) Put simply, he doesn't give a cluck about the welfare of chickens. He wants to protect profits.

As the graphic below states, the current industry recommendation is for a cage with a footprint SMALLER THAN AN 8.5" X 11" PIECE OF PAPER. Is this not animal cruelty?

To be fair, the congressman is probably helping his state, which is what congressman tend to try to do.

I have no idea if this is the result of California's law or not, but I have noticed that in the last 10 years there has been an enormous improvement in the quality of eggs here in CA. In the past you would have the choice of the cheap store brand eggs and the very expensive free range grain feed eggs, and not every store even had them. Now every store has free range eggs and they even have several competing brands of free range eggs. And you can get a dozen extra large grade AA eggs for around $4.00. The cheap store brand eggs are around $2.25/dozen but the upgrade to free range is cheap and the eggs are so much better and bigger.

The California law is probably illegal under the Dormant Commerce Clause of the US Constitution by regulating out of state commerce. Very complex constitutional issue though. Congress would certainly have the right to nullify the law if it passed a federal law regulating the area.

Of course, Congress would have to actually do work.

As I'm sure you already know, the US Constitution is interpreted in different ways by different people.

I did some research and learned about the Baldwin test. To establish a ban or restriction on a product, a state must demonstrate 1) lack of non-discriminatory alternatives and 2) significant state interest in the ban or restriction.

Number 1 is obviously true because California egg producers won't be able to compete with other states' producers unless imports are restricted. Number 2 is debatable, but clearly there is already precedent for protecting animals from cruelty. And anyone who knows a thing about animal behavior and biology knows that immobilizing an animal is certainly cruel.

Are you really making a Cartesian argument about animal cognition and pain? An animal -- like a baby or intellectually disabled adult -- does not need to conceptualize pain/discomfort in order to experience them.
