I'm not sure why, but I had to read that a couple of times. For some reason, I kept getting the impression they were both off-duty police officers. Just sleeping beauty (who provoked it). IMO, he absolutely deserved it.

So ... to try to start a reasonable conversation ... where is the line? When does it become OK to physically assault a person for verbal attacks? Is that "self-defense"?

No matter how big of a dick someone is, legally, you canít just haul off and hit them. Self defense applies when you feel that youíre in imminent risk of being physically harmed or youíre preventing someone else from being harmed.

I didnít see many details in that article but I suppose it could be argued that the off-duty officer was making threats or acting in an aggressive manner that made the other person fear for his physical safety. Just being pissed off at a racist because he wonít shut up doesnít qualify as self defense.

The article did say the no charges had been filed yet so itís possible the racist off-duty officer knows he was being a shithead and is not filing charges.

Yeah, it's never right, but you can't be surprised when it happens to you. "I can't believe this! I was being a dick, the other person made it clear they that the offensive things I was saying were upsetting, and then they hit me when I kept talking about it!!!"

The police covered it up for a year. Eventually the video was FOIAed and the police had no choice but to fire the guy. Then the union got him his job back because the year delay violated his due process rights.

Burn the entire fucking system to the ground.

Official Misconduct of a Public Servant
  • The State can prosecute official misconduct within two years of discovery of the offense committed. A public servant includes an elected or appointed employee, or officer of the State or political subdivision, a person hired for a particular government function, such as a juror, or a candidate for public office.
All Other Felonies
  • The Ohio criminal statute of limitations for all other felonies is twenty years. These felonies include manslaughter, kidnapping, rape, sexual battery, unlawful sexual conduct with a minor, compelling prosecution, arson, robbery, burglary, aggravated riot, felonious or aggravated assault of a peace officer, felonious assault, and conspiracy to commit any of the above crimes.
Generally, the statute of limitations does not begin to run until there is concrete evidence of the crime, the accused avoids prosecution by leaving the state or hiding their identity, or if the state has prosecuted the accused for the same crime that is currently pending.

Ref: Ohio Revised Code Section 2901.13.

I am a bit confused ... the incident happened April 1, 2020. The department "found out" and fired him in March 2021 ... but the arbitrator ruled it violated a one-year due process clause in the union contract? Something isn't adding up for me there.

This is something municipalities will need to be aware of when negotiating police contracts. That is the time to make changes in these flawed processes and to de-power unions in these cases.

Thatís absofuckinglutely insane and I canít see how it stands up to a free speech challenge, though I see in the article that it sounds like theyíve already successfully charged someone previously.

He only gets 12 years for framing innocent people on meth charges, as well as perjury, possession of meth, and racketeering charges. He got much less than the people he framed received or would have received.

I caught that on television news out of SLC while we were in Utah. The station thought it was outrageous. They presented both sides of the story, but they made the sheriff's department look like asses.

The "antifa bus" thing has been going on for a couple years now, and every single time it's about townfolk turning up in droves to STOP THE BUS, except, and this is a key point, the buses don't exist. The fact that this included Police searching for these buses... what an embarrassment.

IIRC, there is a business started by a Black entrepreneur who started selling these. That is a good idea. Coming from law enforcement seems reeeaaaaally tone deaf.
