A question about CA prop 19 and Full Faith & Credit Clause

Prop 19 on the California ballot is a measure to legalize and tax the sale of marijuana in the state. At the moment the measure is polling slightly well enough to pass. If it does pass, would it be legal to bring MJ bought in CA to other states assuming you can prove you bought it in CA, or would you still be subject to local possession laws?

I would assume you would still be subject to possession laws in other states.

Not only that, but if California were legalize the sale of marijuana, California would still be under federal marijuana laws, and you can bet that the feds would vigorously enforce whatever laws would apply.

It's been a while since I studied it, but judgments and laws are treated differently under FF&C. You're more likely to get an out-of-state judgment enforced than an out-of-state law.

Until the feds say it's legal, it isn't legal.

They could try, but if the state legalizes it, there's no way in hell the feds could keep up with all the sellers. And I'm not just talking individuals, I'm talking your local corner store too. Hell, 40 growers just joined the teamsters. Pot has become mainstream on the west coast and the feds cannot put the genie back in the bottle.

It's illegal for me to take tobacco or liquor over state lines into Utah -- somehow I don't think marijuana is going to be any different.

Won't matter much. The Marijuana growers are unionizing, so soon legal marijuana will be way too expensive anyway, and the underground marijuana growers will still be in control...

Technically, you'll be able to buy it in California and bring it to another state, but nobody ever makes it that far because pot is a gateway drug and by the time you're driving across the border you're so high on meth you can't see straight and no, scratching the imaginary insects off your sores is not a valid excuse for a car accident in the great state of Nevada.
