These innocent companies are being punished, not because they did anything wrong, but instead, because the jury wants to "spread the wealth."

NEW YORK, May 7 (Reuters) - Teva Pharmaceutical Industries (TEVA.O) and Baxter Healthcare Services (BAX.N) on Friday were ordered to pay a combined $500 million in punitive damages to a Nevada man who contracted Hepatitis C during an outbreak two years ago.

The Clark County District Court jury in Nevada ordered Teva to pay $356 million and Baxter to pay $144 million in the largest jury award in Nevada history, attorney Robert Eglet said.

In a statement, Teva said it "plans to contest the verdict vigorously."

A spokesman for Baxter did not immediately return messages seeking comment.

Eglet said Henry Chanin and more than 100 others contracted the liver disease Hepatitis C after the anesthetic propofol were reused for colonoscopy or endoscopy procedures. Teva made the drug and Baxter distributed it, Eglet said.

Teva said it continues to believe that the evidence shows the company acted responsibly. The label for its propofol product clearly states that it is for single patient use only and that aseptic procedures should be used at all times.

Chanin's trial marked the first of what could be many, said Eglet, who is representing more than 40 Hepatitis C patients.

I don't see where in the article it states that the jury awarded that much in damages because they want to "spread the wealth". Please explain where it is that you found said statement, and what relevance it has to the nature of the judgment.

Well, I've done a basic search and read a few articles on this. None of them adequately explain what Teva or Baxter supposedly did wrong.

Here's the core of the allegation:

Eglet and Will Kemp, who represents Lorraine Chanin in the suit, argued throughout the trial that the jumbo-sized vials of the drug led to reuse, causing contamination and infection. They also said the warnings on the vials themselves and on drug packaging inserts were inadequate.

It didn't say so in the article, but the jurors went where the money was (the two medical companies), not where the guilty party was (the doctors who reused needles (or whatever)).

According to the Las Vegas Sun article (thanks Jason), the "jumbo" vials were 50 milliliters. How much is typically used by a patient --is 50 milliliters ever appropriate? How much are are in the new "tall" vials (to use Starbucks nomenclature)?
