So this guy in Washington state gets convicted of rape.

They let him out of jail early on parole. While on parole, he raped someone else, and got sent back to jail.

Then later, he got convicted of a third rape.

In addition, he confessed to 18 other rapes.

Now, after spending $1.2 million on "treatment," the government is letting him out of jail again.

And with this new plan, he won't even have to wear an electronic bracelet anymore.

Why do they keep letting this guy out of jail?

A Shelton man carries a heavy burden. So does law enforcement. And neighbors of where ever he ends up living. The Seattle Times has the story of Gary Cherry, who is the first inmate in the Washington prison to complete an intensive treatment program at a cost to taxpayers of $1.2 million. If he falters, he basically implodes any perception that the treatment works.

Gary E. Cherry lives a quiet life in Shelton with a devoted wife and two children. He works as a mechanic and bowhunts with his best friend.

But the 49-year-old Cherry is far from average. He's a thrice-convicted rapist, and one of fewer than 300 men in Washington to be labeled a "sexually violent predator."

And as early as next month, Cherry could have an even rarer distinction: he would be the first person ever to fully graduate from the state's Special Commitment Center for sex offenders on McNeil Island and become a completely free man.

It would make Cherry a high-stakes test case for the state. In its 17-year history, no other resident has gained the SCC's full backing for an unconditional discharge. Cherry has gone through eight years of intense treatment at a cost to the public of about $1.2 million.

"If he fails, it would be devastating to the public perception of treatment and the hope that there is a light at the end of the tunnel," said Henry Richards, the SCC's superintendent. "It's unfair, but that's the reality of how it's being viewed."


But Mason County Sheriff Casey Salisbury says he'll be watching Cherry closely.

"I don't think you can ever fix that sort of thing," Salisbury said. "I'm just not buying this stuff [treatment] will make you better."

Cherry has been allowed to be home since 2004, as long as he followed 48 conditions, including wearing a satellite-locator bracelet and having a preapproved chaperone with him for most trips out of the home.

If the discharge is granted at a Feb. 8 hearing in Mason County, he won't have to follow those conditions anymore, although he will have to register as a sex offender.


An annual SCC evaluation filed in court earlier this year says he has worked to check his "psychopathic" impulses with the help of his wife, employer and friends, all of whom declined to comment.

Cherry said in his evaluation that his wife, whom he married in 1984, is a "a very understanding woman." They have a daughter, 17, who lives at home and knows of her father's history, and a son, 22, who acts as his chaperone on fishing trips.

Cherry's wife described her husband as an attentive mate who shares everything -- even his attraction to other women. "We don't really ever fight," she said for the evaluation.

But Cherry's community-corrections officer, Robert McIntosh, said he was uneasy about Cherry because of an incident last June when schoolchildren accused Cherry of yelling and chasing them in front of his home. The allegations were quickly deemed baseless by a prosecutor, but McIntosh thought they were dismissed too quickly.

"People seem to be running from the liability," McIntosh told the SCC evaluator.

Cherry himself told the evaluator he is so conscious of his behavior that he will avoid women and children in a grocery store. If granted full release, Cherry told the evaluator, he would rely on his wife to monitor his behavior.

"Ask me anything," Cherry said. "I'm an open book."

Gary Eugene Cherry is a convicted sex offender who is being released from the Special Commitment Center at McNeil Island where he has been living in the Transition Facility since February, 2003. Cherry has been convicted of three separate sex offenses;

The first conviction was in 1979, Rape 2nd , Grays Harbor Superior Court Cause # CR-354. Cherry befriended a barmaid, received a ride from the barmaid, mislead her to a remote location and subsequently forcibly raped her multiple times.

The second conviction was Indecent Liberties with Forcible Compulsion, Grays Harbor Superior Court Cause # 86-1-00105-3. Cherry met a 19 year old female with her 7 month old child at a fishing pond and again befriended her. After about 30 minutes of conversation, he grabbed at the female, pulled her out of her vehicle, and pulled her shorts off all while threatening her and attempted to rape her. The victim was able to fight back and fend off Cherry who apologized and asked her not to tell the police. At the time of this attack Cherry was on parole for the Rape 2nd.

The third conviction was Rape 2nd , Mason County Superior Court cause #90-1-0129-6. Cherry met a 21 year old female at a café where they played darts until 1:30 am . Under the guise of giving the victim a ride to her house, Cherry instead took her to a remote location and raped her multiple times and physically assaulted her.

Cherry has made admissions to raping 18 other females. He has never been convicted or charged with any of those incidents. In 1999 Cherry was Civilly Committed in Mason County Superior Court, 99-2-00218-4. This legal action placed him in the Special Commitment Center at McNeil Island where Cherry participated in a 6 step sex offender treatment program where he advanced to the 6th step in September, 2002. In February, 2003 Cherry was released, by court order, to a less restrictive alternative placement at the McNeil Island Community Transition Facility. Cherry’s therapist has stated, “..been able to consistently demonstrate an ability to meet all of the goals and expectations for phases 1-5.. and ..a commitment to his discharge plan..” On 11/4/03 Cherry was ordered by Mason County Superior Court to be conditionally released to a less restrictive alternative placement to his private residence in Shelton . He is on supervision with the Department of Corrections, continue with sex offender treatment, and to comply with all court ordered conditions. Due to these factors he is considered a HIGH RISK.

Gary Eugene Cherry is restricted from the following; Cherry shall not be at large alone in the community. Cherry shall continue with Sex offender treatment. Cherry shall be on DOC supervision. Cherry will be subject to a GPS monitoring system. Cherry shall have no intentional direct contact with minors or adult women (other than Family members) without the presence of an approved monitor. Cherry shall not enter onto the premises of any college, school, daycare, park, recreation area, theater, or other facility normally frequented by adult women and minors without approval of the transition team. Cherry will not enter any public washroom or other rest facility that has not first been checked for the presence of minors and is found by an approved monitoring adult to be free of minors. Cherry shall not driver any motor vehicle or possess a driver’s license without written permission from the transition team. Cherry shall not purchase, possess, or view pornographic materials. Cherry shall not use the internet without direct supervision of a monitor. Cherry shall not use or possess alcohol or controlled substances. Cherry shall not go to bars and taverns. Cherry shall submit to searches of his person, computer, residence or property at the discretion of DOC.

Law Enforcement and/or peace officers are authorized to arrest Mr. Cherry for any violation of these conditions.

Gary Eugene Cherry is assessed by the Mason County Sheriff’s Office as a Level III Sex Offender.

This is the highest level given to a Sex Offender, meaning that the subject is at a HIGH RISK to re-offend.

I just edited it to add bolding to this part.

Please note that the SCC's superintendent doesn't care about the women that this guy rapes - he only cares about public perception of the rapes.

Also, please note that he says it's "unfair" for the public to judge this "treatment" based on the actual real world results.

I voted "Other" because I dislike "Oh my God! The prison system is all screwed up and I know I'm right because I read a shoddily reported article by some AP stringer!" posts.

Based on the facts we have, this guy doesn't seem like he should ever get out of prison. But I am 100% sure we do not have all of the relevant facts.

And I am 100% sure that at least part of the explanation for why this guy is now out of prison is tied into overcrowding. And that, in turn, can be directly linked to the war on drugs, and the idiotic mandatory sentence laws.

I think rapists oughta serve a minimum of 20 years, no parole, for each rape. Can't stand those bastards.

Big surprise, the libs advocating/enacting this type are more interesting in trying to prove the validity of their social experiments than the welfare of the general public.
