I was able to get most of my answers right from watching a lot of "Cops." I thought #1 seemed a little obvious, at least to me, since I never associated 9/11 with additional traffic stops. Racial profiling, maybe, but not the Patriot Act.

2 and 5 I get, but what about #6? I was thinking of a recent event in which the state asst AG was charged with a DWI. She hit a car, tried to drive away, and police pulled her over, smelled booze but she refused to do a breathalyzer test and thus was charged with a DWI.

What I got from that was she was charged with a DWI for refusing the test, a form of a search. Or the expected DUI charge was just upgraded to a DWI because of the refusal? How is it on one's favor to refuse it? How can police prove their case?

DWI is a special case, since as part of getting a driver's license you agree to consent to breathalyzer tests, and it's on the books that you can be brought in for refusing the breathalyzer. In general though, a refusal to consent to a search does not give the police probable cause to search (though sometimes they do it anyways).

I got 7/8, missed #1. And you've gotta give some credit to Mr. Balko for pointing this quiz out to you, RD. I had thought about posting this after reading it on The Agitator this morning.
