Actually, incitement is not protected free speech. For example, inciting a riot is illegal.

The lives of young men don't matter, didn't you know?

Re: Teen talks another through a suicide..

This bit from the girls lawyer is just awful. He should be ashamed for even trying to blame the dead victim. Some people are just evil. So he and his client are a perfect match made in hell.

Her attorney argues, however, that the charges should be dropped because Carter’s messages are protected by free speech. According to attorney Joseph P. Cataldo, Carter was “brainwashed” into supporting Roy’s plan for suicide.

“He ultimately persuaded a young, impressionable girl,” Caldato told reporters, according to South Coast Today. “Eventually he gets her to endorse his plan.
What a jerk to even think this. It's obviously the other way around, with Roy being the impressionable one that was manipulated and pushed by Carter into killing himself.

Some are apt to forget that Mr. Cataldo's only motive in this case is to profit monetarily from it, scumbag lawyer that he is.

Re: Teen talks another through a suicide..

Wasn't there a case a few years ago where a crowd urged a woman to jump from a bridge? I thought it was in Detroit ...

Anyway, her speech is not protected by the First Amendment as free speech. From http://www.firstamendmentcenter.org/...estions-speech

Which types of speech are not protected by the First Amendment?
Although different scholars view unprotected speech in different ways, there are basically nine categories:
Obscenity
Fighting words
Defamation (includes libel, slander)
Child pornography
Perjury
Blackmail
Incitement to imminent lawless action
True threats
Solicitations to commit crimes

Some experts also would add treason, if committed verbally, to that list. Plagiarism of copyrighted material is also not protected.

True. But it still pisses me off that people can be so cold and evil.

Speaking of which. To anyone who is depressed and thinking of suicide. If you find anyone trying to 'console' you into thinking it's okay to just go for it and or pushing you to do it. Get the hell away from them immediately before they completely worm their way into your mind and break your will power. I've met people like that, and they scare the hell out of me. You can't reason with them, and they'll just fuck with your head, to make you doubt yourself, even though your conscious is telling you otherwise. So get away from them. Once red flags start going off, don't ignore them, it'll save your life.

Re: Teen talks another through a suicide..

Guilty.

I'm normally a fierce defender of free speech, and opposed to any hate-speech laws, etc. I'm no lawyer, but to me this was direct incitement to imminent violence, which is not protected speech. Whether that should make her guilty of manslaughter, I don't know, but I think she does bear legal culpability of some sort.

Carter found guilty in texting suicide case

By Maria Cramer and John R. Ellement

GLOBE STAFF JUNE 16, 2017

TAUNTON - Michelle Carter, who repeatedly urged her boyfriend to kill himself, was found guilty of involuntary manslaughter Friday by a juvenile court judge, ending an extraordinary trial that explored a virtual relationship between teenagers that ended in a suicide.

Judge Lawrence Moniz delivered his verdict after deliberating for two days in the jury-waived trial in Bristol Juvenile Court where Carter was being tried as a youthful offender. The trial riveted lawyers and the public alike as it delved into the painful interior lives of two teenagers who called themselves boyfriend and girlfriend though they had met in person only a few times.

Bristol prosecutors alleged Carter should be held criminally accountable for the death of Conrad Roy III even though she was not present when the 18-year-old with prior suicide attempts filled his truck with carbon monoxide from a gasoline-powered water pump and died on July 12, 2014.

Speaking from the bench, Moniz concluded Carter was guilty of involuntary manslaughter, in part, for ordering Roy back into the truck in what she knew was a toxic environment where it would take him 15 minutes to die - and failed to notify anyone as required under Massachusetts law. Cellphone records showed a 47-minute phone call between Carter and Roy that day.

Moniz said before finding her guilty, he wanted evidence confirming that Carter listened on her cellphone as Roy became overcome by the toxic fumes and slowly died. He said he found the proof he was looking for in some of her text messages where she described hearing the loud noise of the generator in the background – and the sound of Roy coughing as he inhaled the carbon monoxide.

“Miss Carter had reason to know that Mr. Roy had followed her instruction and placed himself in the toxic environment of that truck,’’ Moniz said. “Knowing that Mr. Roy is in the truck, knowing the condition of the truck. Knowing, or at least having the state of mind that 15 minutes must pass, Miss Carter took no actions…She called no one. She did not issue a simple additional instruction: Get out of the truck.”

Moniz, who deliberated for two days, also said the case was not legally novel since a Massachusetts inmate was prosecuted in 1816 - but acquitted - for convincing a man facing the death sentence to hang himself in his cell before he was executed. The judge also cited the prosecution of squatters who accidentally started a fire inside the Cold Storage warehouse fire in 1999 that killed six Worcester firefighters for not alerting first responders about the blaze.

Moniz also noted that Roy had a long and troubled psychiatric history that included multiple suicide attempts - but each time he stopped and sought out help from his family and friends. And, the judge said, the possibility that Roy would have killed himself at another time had he survived the suicide in Fairhaven was not part of his consideration.

A defense psychiatrist, Dr. Peter R. Breggin, testified that Carter was “involuntarily intoxicated” by the SSRI prescription drug she was taking in the weeks leading up to Roy’s suicide. Breggin testified Celexa, coupled with her own psychiatric condition, created a “grandiose’’ belief on Carter’s part that she alone could guide Roy to heaven and take care of his family afterward.

Following the verdict, Roy’s father thanked Bristol prosecutors and law enforcement for pursuing the investigation into unusual legal territory. “This has been a very tough time for our family and we would like to just process this verdict that we are happy with,’’ said Conrad Roy II, who did not take questions from reporters.

Roy’s mother, Lynn, who testified for the prosecution during the trial, left the courthouse without speaking to reporters. Carter and her family left without speaking to reporters.

Bristol Assistant District Attorney Katie Rayburn told reporters Carter’s conviction was not a victory for anyone involved in the case but was warranted by Carter’s actions. She also called the death of Roy a “unique case” that “dealt with a lot of important issues in our society.”

“Two families are torn apart and will be affected by this for years to come’’ she said. “But in the end the case was really about one young man and one young woman who were brought together by tragic circumstances. The evidence clearly showed that not for the actions of Michelle Carter, Conrad Roy would still have been alive on the morning of July 13, 2014.”

Carter’s lead defense attorney, Joseph P. Cataldo, said he was “very disappointed” by the verdict, but declined further comment.

Carter, who sat hunched forward, a tissue in front of her face as her lawyers confer as Moniz delivered his verdict, was allowed to remain free pending sentencing which is set for Aug. 3. She faces a maximum of 20 years in prison.

Re: Teen talks another through a suicide..

It's certainly a case that deserves attention--and a good read about what this woman did--when it comes to "suicide assistance". Because this was far from it. This young woman controlled many aspects of the victim, and to think he wouldn't kill himself, is just an outright falsity on the defense. Carter should have called for help, but did not. She not only created the conditions of this young man's death...but sealed his death in stone when she refused to do anything about it.

Re: Teen talks another through a suicide..

This fucking c$%t is basically only getting a slap on the wrist for the part she played in this kid's suicide. What bullshit. Maybe she wasn't 100% directly responsible in the kid's dying, but she definitely played a large part in this horribly tragedy. This just again proves what I've always known - if you're a a female (and it helps if you're attractive as well), you can get away with almost anything you want. If she had been a male (of any race), I'm sure she would have gotten a harsher sentence:

https://www.law.umich.edu/newsandinf...sparities.aspx

http://www.dailymail.co.uk/news/arti...sentences.html

https://goodmenproject.com/ethics-va...o-prison-mrzs/

https://www.avoiceformen.com/misandr...riminal-court/

And, comparing this evil bitch to Kevorvian is also bullshit. Though I don't agree with what Doctor K. did, he was not helping healthy people to die - these were all terminally ill patients who had already gone through a lot of pain & suffering, and who were going to continue suffering until they passed. They just wanted this to end, and he helped this along. Again, I don't agree with this but it's not even close to being the same thing.

"Evil" is a pretty good word. I don't know how else you'd describe her actions.

Re: Teen talks another through a suicide..

I read the Kevorkian mentions as a way to find legal precedent, not necessarily a direct comparison.

Interesting case, though. Unless you believe the defense's position that she was also whacked out on prozac and not in her own right mind, it sure looks like she wanted him to die ...
