Surrendering Driver's License Question
So just moved to Indiana, got a new driver's license and they took my old one away.
I asked to see a copy of the relevant law regarding this and was shown this:

Excerpt: Must Surrender out of state ID If used as a sufficent proof of identity that conforms to the current list of qualifying documents.
This list:

It says that If I show my passport that would prove my identity to the state.
I did show my passport when I was going through the process and tired to tell this to the supervisor. He kept saying that he was not a lawyer and eventually gave me a 1800 number to call. The person on the other end was a dick, also couldn't provide me with the law and told me to call the legislator.
Now I can't call them till monday and my question to the otters is: Do I have a leg to stand on here? I would hate to have another gap in my old ID collection.

In Illinois, they usually cut off the photo and hand it back to you. I guess there are a lot of people that don't have cameras.

I think the difference is that your DL proves that you are a registered driver, where your passport only proves that you are a US citizen and is used for identification purposes. I am sure that if you went and said that you needed to take the drivers test, since you lost your old ID, they would have used your PP as identification, had you take the test and then issued you a new DL. That's what I did when I moved to Colorado.
On a side note could you have moved to Idaho, Montana, North Dakota or Wyoming instead so that we could have filled out the 50 state check in list? Think Otter before you move next time...

Technically the license is property of the state that issued it ... I would call the State Police back home and file a theft report ... advise them that you have been the victim of identity theft.
Honestly, I'm not sure that another state could require you to surrender it ... the issuing state can.
(I was trying to come up with a French surrender joke ... I'm stuck though.)

Moved from Illinois to New York and when I went to renew it, they also kept the old one and I had to retake the written test (it might have expired). That was a while ago but I assumed it must have been standard operating principle.

On a semi-related side note, you better make sure they send it back to the state that issued it or keep proof that you surrendered it. When we moved to Colorado from Texas we were also required to surrender our Texas licenses. A few years later I was visiting Texas and was pulled over. When the officer ran my Colorado license it also pulled up my Texas license that still showed as valid and I was given a ticket for having two licenses. When I got back to Colorado I had to go to the main licensing office there and waste a lot of time to get a piece of paper confirming that I had surrendered my license and I still had to pay the $10 B.S. charge to Texas to get it dismissed.
