Should wearing military medals when you never served be a crime?

http://lacrossetribune.com/news/loca...cc4c03286.html

MADISON A West Salem man has been accused in federal court of wearing an Army uniform in the Sept. 25 Maple Leaf Parade even though hed never served.

Gary Spors, 26, could face up to six months in federal prison if convicted on the misdemeanor charge of wearing unauthorized military medals.

The information filed today in U.S. District Court in Madison had few details, but contends Spors appeared in the Oktoberfest event in uniform, with a major rank insignia and combat infantryman and parachutist badges.

La Crosse and Onalaska police and the FBI investigated the case, which has been assigned to First Assistant U.S. Attorney Stephen Sinnott.
^From my local paper. I don't think this should be illegal. It's pathetic, and if a bunch of vets kicked his ass I wouldn't mind, but six months in federal prison is stupid.

I could see this being a Federal offense if the insignia and/or uniform were worn to further the commission of a crime. Simply as a standalone offense, no, I don't think I agree with that.

Edit: As far as I can tell, the Federal statute in question is 18 USC 704(b)

It's the equivalent of lying on your resume. Skuzzy, but not a federal offense.

Federal prison seems too harsh. Community Service would be more appropriate.

...and yet drug abusers and petty criminals often get prison time instead of community service. I think it is a crime and he should be fined and given community service, but not time in a federal prison.

I'm not sure how this statute could stand up to First Amendment scrutiny.

There should be absolutely no penalty at all. This is America, not fascist Italy.

I was implying that here is a guy who impersonates a service member/Veteran, and people are saying it isn't a big deal, yet there are thousands of minor drug offenses that have landed people in serious prisons, and most people are like, "eh, whatever".

Tom Cruise is guilty of this in almost every movie. If this is allowed then, they'd have to send him to prison too-

Oh wait. Yeah, I'm for it.

Impersonating an officer in the military for nefarious reasons, Yes. Wearing medals on a jacket, No. -kd5-

If someone is wearing the medals in a fashion that suggests they earned them, and they didn't, veterans should be allowed to bruise them heavily.

But, only veterans.

Re: Should wearing military medals when you never served be a crime?

I once beat a guy to within an inch of his life because he was wearing a jean jacket with some Atari 2600 Activision badges that I know he bought on ebay, but I don't see the problem with the military uniform thing.

I think he should be ass raped by a bomb sniffing dog who served in Iraq.

I do not think he should be forced to endure a genital pat down in an airport, because that is just wrong.

Eh, just make him do four weeks of BCT at Fort Leonard Woods in August.

Then send his crying ass back home to mommy.
