YAET: Advice Needed, Please

Received this e-mail in response to a card I sold on eBay in July:

"Dear indianajdp,

Package was damaged and open by USPS and card was not inside. I will be on vaction until Aug 16
so can't respond until then. I know it's not your fault ---hope ebay protection plan may actually work in this case. "


My immediate response:

"Wow....that's ridiculous. So sorry that happened. Does the process need to start on your end or mine? I'll certainly do whatever I can to assist."

That was 8/05.

Received this today, asserting the following:

Details the buyer provided:
Problem: The item is not as described
The buyer has tried contacting you
The buyer paid on Jul 29, 2010
The buyer contacted you through eBay Messages
The item has missing parts or pieces
You have not responded to the buyer
You aren't working with the buyer to solve the problem


Additional information:
"No Response"

The buyer wants:
A full refund


Responded back, in kind, basically asking, WTF? Said I stil had his original e-mail and would still do whatever I could to assist, but I couldn't understand his change in direction. For the record, that initial e-mail was his only message to me.

My question is, other than responding thru eBay's open case (which I just did) is there anything else I can do, proactively? Do I e-mail anyone at eBay or Paypal with the facts and his original e-mail?

100% feeback and now this garbage.

Did you buy insurance? That would be the only thing I can think of that you could proactively work on.

Nope. It was a $17 sale. He got an absolute steal...and maybe going for the total steal.

you're pretty much SoL if he claimed the product is not as described due to damage in shipment, unless you put a disclaimer, and even then, it's a hard sell for ebay/paypal.

though, according to paypal rules, the buyer has to ship it back to you at his expense. if he's a scammer though, it might just be a box with a rock in it.

That's what I'm afraid of, but it sucks ass that someone can claim this with absolutely no proof whatsoever. Where is the damaged package? Would the USPS leave a slip (with some sort of trackable # on it) if it were shipped and was opened somewhere en route?

Predictably the guy who claims I did not respond to him is not responding to me. Makes me believe more and more this is an orchestrated sham. Wonder how easy it would be to return the favor...proably very easy since I guess I don't have to prove anyting, just make the damn claim. Ugghh.

If you have the balls, get his phone # from eBay and give him a call. He'll either be a defensive prick or shit bricks when you call and tell him who you are.

People think they can always hide behind their email. Part of the reason that this generation is full of such bums. Texting and emailing, instead of just talking to people. They don't feel the responsibility when they're sitting behind their computers.

If USPS opens up a package to inspect it there will be proof on the packaging as such. I'm not sure of the exact wording but they tell you they opened it up.

If this was stolen in transit by some rogue postal worker then you're screwed. I'd ask him for a picture of the packaging with the stamp or whatever the post office uses telling you they opened the package. They don't just do it and not say anything.

Or it may be a misunderstanding; maybe your e-mails are being caught in his spam filter. Agree with the above, give him a call.

certainly doesn't hurt to call him on it, but at the end of the day, if he sticks to his guns, not much you can say.

Yea. But I find that people are real cowards when you confront them. Like I said, everyone hides behind emails and text messages these days.

I say that you should call the guy. Tell him who you are, and that you need to get this sorted out. Tell him that the item DID ship in the package. I don't get what kind of "card" it was. But tell him that he likely lost it when he opened the package. Ask him exactly who opening the package, was he there at the time, did the opener know what they were looking at, did someone accidently throw it away, etc. Tell him that you shipped it, he received it, you believe that you're being ripped off, and you're not going to give him a refund (not everyone knows EXACTLY how eBay functions).
