A DIRE warning against downloading/purchasing media in non-physical form...

The onslaught of iTunes and the gradual increase in the downloading of movies and videogames has urged me warn my fellow consumers about the overlooked dangers associated with legal downloads.

FIRSTLY, when you buy an album/song/movie/videogame in a physical format, you are an "owner of a copy." BUT when you download something you are merely a "limited non-exclusive licensee"

By downloading, you are subject to a user agreement which is tailored by the content provider and can be changed whenever they please. In the user agreement, you do NOT have any protections as a possessor or "owner" of the content you download. You are merely a user. Importantly, you are also agreeing to the content provider changing the user-agreement at any moment without any notice to you.

Now, traditional copyright laws grant the end-user various protection and freedoms which are absent when one downloads content. Such as various 'fair-use' defenses and the 'resale' right.

By downloading, you are essentially agreeing to the content provider freely deleting, restricting, and restructuring ANY piece of content that is available and that you have already downloaded. That means, if a content provider decides to delete a song from YOUR computer that you have paid to download, they can do so because you don't own the song, you are merely a user. (UNLIKE when you buy a CD, although you don't own the copyrighted material on the CD, you own the plastic and thus can control access to it and use the copyrighted material as you deem fit, without infringing of course) Granted, they don't necessarily do all this but that does not mean they cannot.

Movie studios, record and video game companies are focused on gradually eradicating the concept of copy "ownership" and replacing it with "limited use" principles i.e. use subject to their control. They benefit IMMENSELY.

I am certain all this is familiar to some of you, but most people do not see it through this lens of the fine print and serious curtailment of your rights as a consumer of entertainment content.

So just BUY a CD instead of downloading on iTunes and BUY a film on Blu-ray, instead of a download. Realize that you only benefit yourselves in the process.

There is a good chance you won't own that movie you downloaded and bought last week 10 years from now BUT there is a great chance you will own that DVD you love and can watch it again and again, without anyone telling you how.

I have some similar reservations as you do, but they center more around DRM and a hypothetical situation where you purchase downloadable content, the hard drive becomes corrupted, then you go to re-download on a new drive and the company has shut down or has discontinued that service.

Besides that, I like having physical copies of media. I only download media when I wouldn't care if I lost it forever (i.e., easily replaceable). For instance, I own classic computer games that will probably never be available for download or purchase again, whether in a store, from services like GOG.com, or via P2P. I like the extras (bonuses, omake, whatever).

When gaming goes download-only is probably when I'll bow out.

I guess I'm just the opposite, I pretty much only buy games on Steam now. I think it's great. And even when I get games at a store it is usually on Steam so I don't even take the Disk of out the box and just register it on Steam to get it. I'd be ok with never getting a physical disk of a game again.

As of a couple of days ago all of Itunes music is DRM free, so that's cool.

Buying a dvd or cd doesn't mean you will still be able to play it in 10 years if you do have it. The medium could be obsolete by then. Nothing is permanent.

I've never paid to download anything (if I pay for it, I want an actual disc), and the stuff that I have downloaded has been burned to disc.

Actually, I seem to recall hearing recently about iTunes being able to remove media that you've downloaded from them if they have some sort of problem with it. It actually makes sense, with iTunes being able to communicate with apple to check for updates, for them to just flag some video to be deleted if iTunes sees it in anyone's library.

Of course, if you've backed it up or manually manage media, it may be a moot point, but I'll bet that 90% of most people don't...

Everything I buy from itunes I burn to cd, then rip that cd as wav files with Nero and reburn.
