HR question about takebacks on a raise

Is it legal to give an permanent employee a raise, write them up a month later, then do takebacks on the raise?

Did you call no take backs? I think that's the important question.

If the write up was accurate then I would say they can do what they like. If it's a bogus charge then I would find out if there's some sort of appeal process (or look to see if it's some sort of discrimination thing). Bottom line w/o knowing the company, and the details it's really hard to tell. For the most part though companies are allowed to run their business as they please and I don't think there's any laws about "takebacks" of raises. I'm not a lawyer though so this advice is worth the amount you are paying for it

I'm guessing you are 'at will', so they could just fire you and be done with it, so them taking back a raise is probably within their right. Oh, and this isn't legal advice, as anyone taking advice from me would be an idiot....legal or otherwise.

What are the terms of your employment? Do you have a contract? What are the employment laws in your state?

LOL, it wouldn't be the internet if you did otherwise!

I'm in an at-will state, so you guys are right, they can do as they please. I don't think they did, but I will have to wait until I get my stub to be sure.

You mean retroactively take back that month worth of checks? I don't think so.

If you are meaning taking back the raise that you got, from write up foward. Then yes, they can do that.

I could see some companies having a policy stating a raise can be rescinded within x amount of days due to disciplinary action.

I know where I work, you can't get tuition reimbursement if you have disciplinary action within the last year.
