Any attorneys in the house????

OK so a couple of guys I used to work just got arrested with 42 counts of PC 487a (grand theft). They were also hit with a bail amount of 1 million bucks. What kind of jail time are they going to be looking at?

depends on the sentencing guidelines and if they serve consecutively or concurrently and if they plea out or go to trial

Depends on the jurisdiction, but in Illinois, theft of more than $100,000 is a Class 1 Felony, which means a sentence of 4 to 15 years. Sentences can be served either concurrently (serving all 42 sentences at the same time) or consecutively (the sentence for count 2 doesn't start running until the sentence for count 1 is complete), so worst case scenario for them under Illinois law is 42*15 years = 630 years. That's ignoring aggravating or mitigating factors, which may serve to raise or lower the sentence.

I don't do criminal law, but my sense is that for a property crime of this magnitude, if they're convicted they'll go to jail for a long time but not for the rest of their lives, so I would expect a sentence on the long side of the 4-15 year range, but to be served concurrently.

None of this should be construed as legal advice -- neither you nor the guys who you know are my clients, I don't practice this kind of law, I probably don't practice in your jurisdiction, and I don't know the specific facts of this case.

I'm a lawyer. They should get sentenced consecutively, and should never be free again. OK, I'm not a lawyer. I just have little patience or tolerance of people who have that little decency and steal that much from that many people.
