Indiana Inmates Sue Over Adult Magazines Ban

INDIANAPOLIS Two inmates have filed a lawsuit against the Indiana Department of Correction to overturn a policy that bars magazines such as Playboy and Hustler.

The lawsuit filed Tuesday in U.S. District Court in Indianapolis seeks class-action status on behalf of more than 20,000 state prisoners and challenges a policy that went into effect July 1 barring adult magazines and other printed material that depict nudity or sexual content.

The policy could prohibit sexually explicit letters and publications such as National Geographic magazine and daily newspapers, according to the complaint, which said the new rule violates the plaintiffs' civil rights.

"The policy is written so broadly that it includes within its prohibitions such things as personal letters between prisoners and loved ones and much of the world's great literature and art," said the complaint, which was prepared by the American Civil Liberties Union of Indiana.

One of the two plaintiffs named in the complaint is Ernest Tope, 53, an inmate at the Pendleton Correctional Facility near Anderson who is serving a life sentence for murder. He claims he cannot subscribe to the motorcycle magazine Easyriders because it contains partial nudity.

The policy may also may bar books such as steamy novels by the best-selling author Jackie Collins that have been available in the past through the prison library, the lawsuit claims.

Both Tope and the other named plaintiff, murder and auto theft convict Wade Meisberger, 34, challenged the new policy through the prison grievance system but so far have been unsuccessful, the complaint said. Meisberger, 34, is held at the Miami Correctional Facility near Peru.

DOC spokeswoman Java Ahmed said agency officials had not yet reviewed the lawsuit and had no comment.

ACLU dues money well spent...protecting convicts "right" to porn, and their right to the "world's great literature and art".

Perhaps the ACLU should stand for American Crazies Liberties Union or American Criminal Liberties Union...since they seem to only take on tasks that fight for and/or protect the "rights" of the criminals and nutcases that plague our society.

Are they allowed "men's mags" like Maxim or Stuff?

I think the ban is ok.. Not because they will turn into worse criminals, but they are in prison. It is supposed to be tough. Give them porn mags and it's like a college dorm

No kidding. Prison isn't supposed to be all bunny rabbits and candy canes. It's PRISON. Bread and water, and getting boned up the butt by Bruno in the next cell is too good for some of these people.

Prison is not about getting raped. While I don't care if they can't have mags, I will say that I think prison rape should not be tolerated and I'm pretty sick of all the smartass comments about it in every crime related thread.

No no no, pot dealers who received the maximum allowable sentence to "serve as a warning" should be violently raped on a frequent basis.

No, it's better when the population decides to brain someone with a baseball bat for the likes of Jeffrey Dahmer. I think they only killed him because they figured boning him up the butt would be enjoyed a little too much.

Exactly. Heh heh.

There are so many things that annoy me about that strain of "debate". It's debased and crass. It's immature. It suggests that our prisons should be lawless pits of chaos. It ignores the fact that prison rape only makes things worse for everyone involved. It's pretty anti-male (let's see lots of jokey posts about raping women and see how well that goes) and it's often pretty racist as well ("BIG BLACK CELLMATE NAMED BUBBA HURR HURR!!!!11!). I read an article about prison rape in a law journal once and it really pissed me off. I've noticed a lot of otherwise intelligent posters on this board turn into drooling animals cheering for rape in cases like this. It just bugs me.

I doubt that's why they killed him. Surely they either killed him because it would be badass to be the person who killed such a notorious killer or because prisoners have weird codes where certain criminals are beyond the pale. That said, the guy who killed Dahmer was hopefully charged with murder. I mean, prisons aren't fucking thunderdome. You have to keep that shit in check!

I don't think that porn - such as adult magazines with pictures- should be allowed.

However if a g/f or wife is writes an explicit letter, or any literature -written words- should not be banned.

You know, I thought that the mags would be a good idea because it would relieve tension, keep the civility of the place at some form of a placent level, and prevent some of the individuals whom got caught up in a crappy situations (i.e. weaker, younger kids who made a bad mistake) from getting violated and hurt.

However, having the porn might keep them sexually interested and active, instead of eventually losing all interest. Not sure which one to believe.

A lot of men in prison are 18-25 and are full of testosterone. They're not going to "lose all interest" anytime soon. Better to have a non-violent outlet than let their eyes start to wander to their (unwilling) cellmates.

The mags will suffice for awhile, then they won't. And then why masterbate when you can rape. Masterbation is not nearly as socially acceptable in prison and good ol' wholesome rape.

I support the free Real Dolls for all prison inmates. Or atleast a liberary like system where Real Dolls can be "rented" out.

You may want to change the subject title. If you read the article it doesn't say that is explicity what the suit is over. The convicts, in my opion, are lucky the ICLU picked this up, and it wasn't because they banned adult magazines such as Playboy and Hustler. The OP pointed this out by putting in bold, and yet the conversation has stemmed, for the most part, around PB and H. I think if the law were rewritten to say they are not allowed explicit items such as PB and H, etc. then the ICLU would not have a problem with that.

For what it's worth, I don't think they should have any of those types of materials. While they are at it they need to lose cable tv and other such ammenities.
