is there an ebay policy if your sent the wrong item ??

So here's the deal. Last week I bid on a Sony PSP and win. The final price was $170 and $30 for shipping. I pay via paypal after the auction is over and I just need to wait patiently for my PSP to arrive.

Four days later, I get an email from the seller. He says he shipped me the wrong item (an iPod nano). This guy doesn't seem like a power seller by ebay standards. It looks to be a regular dude auctioning off some stuff. At the time I won the PSP, he had three auctions (the psp and 2 nanos).

So he writes me an email saying to return the nano and he'll send the psp when he receives the nano. I tell him I understand he can't ship the psp until the nano arrives, but I tell him he should refund the shipping costs to me upfront via paypal. He writes back saying he can't pay up-front for the shipping.

Basically we need to go on the "honor" principle here. In my books he should pay for the shipping mistake. It was his mistake, and as a buyer I have fulfilled my end of the agreement. However this guy doesn't seem to want do anything to rectify his mistake.

Any ever been in a similar situation ?? Does ebay have some sort of guideline or policy regarding such events ??

His fault. He pays for his mistake. I would send back the nano once I have the PSP if he reimburses for shipping later. If he pays for it now, I'll gladly send it now.

Yea he should definately paypal you the amount it will cost you to ship the nano back BEFORE you actually ship it back. If that don't work.. Take him to small claims court.

If the guy with the PSP was smart, he'd say he received only his Nano.

I'd keep the nano. Sell it on ebay and make $10-$20.
